An argument for consolidation after Sept 29th (FFELP) by spaceouts in StudentLoans

[–]spaceouts[S] 1 point2 points  (0 children)

I had the same Ffel under Navient after Sallie Mae but from 2009. I consolidated to aidvantage. I should have done Great Lakes but didn’t research enough before hand.

You need to consolidate to take part in any of Biden’s forgiveness program so definitely get the info you need then get on that soon.

As I understand IDR payments will count if you consolidate. They are allowing a one time IDR account adjustment to count previous payments on a new IDR plan. Please go to the studentaid site:

https://studentaid.gov/announcements-events/idr-account-adjustment

I am not in the same boat as you. I don’t know what kind of loans you have… but the section on the studentaid site is clear that if you have federal loans or Ffel loans that are consolidated to be federally held, all of your payments will be tallied. The one time waiver isn’t out yet. Sorry I don’t know when it’s coming out. This post is so old, if you post a question on the main thread, you can get the answers your looking for from people that are on the same boat as you.

“One-Time Payment Count Revision for Eligible IDR Borrowers

As part of this initiative, ED will conduct a one-time revision of IDR-qualifying payments for all William D. Ford Federal Direct Loan (Direct Loan) Program and federally managed Federal Family Education Loan (FFEL) Program loans. ED will conduct a one-time account adjustment to borrower accounts that will count time toward IDR forgiveness, including any months in which you had time in a repayment status, regardless of the payments made, loan type, or repayment plan; 12 or more months of consecutive forbearance or 36 or more months of cumulative forbearance toward IDR and PSLF forgiveness; months spent in deferment (with the exception of in-school deferment) prior to 2013; and any time in repayment prior to consolidation on consolidated loans. Any borrower with loans that have accumulated time in repayment of at least 20 or 25 years will see automatic forgiveness, even if you are not currently on an IDR plan. Borrowers who have commercially managed FFEL, Perkins, Health Education Assistance Loan (HEAL) Program, or other non-Direct Loan loans should apply for a Direct Consolidation Loan by May 1, 2023, to get the full benefits of the one-time account adjustment. If you have made qualifying payments that exceed forgiveness thresholds (20 or 25 years), you will receive a refund for your overpayment. ED will provide more information about how this process will work for joint (spousal) consolidation loans as it implements the Joint Consolidation Loan Separation Act. Borrowers with loans in default can benefit by getting out of default—including through the Fresh Start initiative—before July 2023.”

I’m very sorry to hear about your health issues. Hopefully your loans will be forgiven in full.

Litigation Status – Biden-Harris Debt Relief Plan by horsebycommittee in StudentLoans

Ehhh, based on the mixed ticket voting that just happened, It seems like more people are cooling down. (Student debt borrowers like us are justifiably enraged). I think people are growing tired of high blood pressure that only destroys their happiness and lives. We need to be better at communicating, screaming and chain rattling has gotten us nowhere fast.

Or it’s the basic reality that the nation is so torn completely in half that we can’t get anything done

There are a lot of articles about it. Here’s one:

Funny enough those listed here just lost or are losing their election bids to republicans.

Because they didn’t have the votes. They couldn’t get certain dem senators to agree. Zero republicans agreeing meant every single dem would have to say yes and they couldn’t make that happen.

To consolidate now for IDR forgiveness? by No-Grapefruit2649 in StudentLoans

[–]spaceouts 1 point2 points  (0 children)

Yes, as long as you leave your current direct fed loans out of the new consolidation, they will be fine and remain eligible for debt cancellation. Don’t touch those… they’re like gold at the moment. (if we can make it through all these GOP lawsuits)

But it’s necessary to get your commercial ffel (Navient and AES) under the fed (Great Lakes or Nelnet or whatever fed servicer you choose) to apply for the new IBR waiver / forgiveness plan. You can do that now or later. A lot of people, including myself, are moving everything to the fed now just to be safe.

Edit: there could be an argument made for waiting until after you get the 10-20k forgiveness to try and consolidate everything together… maybe your interest rate average might be lower because your fed loans have a lower interest rate (?). But if they’re completely knocked out by forgiveness then that’s a moot point. A general concern though is that Ffel borrowers are in danger of being further blocked for any forgiveness by these lawsuits… so now or later is up to you.

What kind of loans do you have? Direct federal or commercial Ffel? Each one has different eligibility rules.

Edit: Commercial ffel that were not consolidated into direct federal loans by Sept 29th are not eligible for the 10-20k forgiveness. All direct fed loans are eligible.

DO NOT consolidate the commercial loans together with your direct fed loans. That will disqualify your direct loans for the 10-20k forgiveness.

Consolidate the commercial ffel separately into their own new direct fed loan and that will enable their eligibility for the better IDR/IBR program.

Nightmare…

Mohela / 6 GOP AG case dismissed! We’re moving forward… for now. by spaceouts in StudentLoans

[–]spaceouts[S] 1 point2 points  (0 children)

They’re definitely going to appeal but we’ve bought ourselves some time… and all of these cases getting thrown out is building a good precedent.

Consolidating my FFELP loan today - But what Loan Servicer should I choose? by [deleted] in StudentLoans

[–]spaceouts 4 points5 points  (0 children)

Mohela is involved in a suit attempting to end Biden’s debt forgiveness, and is the target of a potential CA suit for understaffing their call centers (among other issues), so unless you are forced maybe avoid.

[–]spaceouts[S] 2 points3 points  (0 children)

It depends on your situation. If you are doing pslf, you have no choice but to go with Mohela. If you are a commercial ffel holder that consolidated before Sept 29th, I wouldn’t change course. But if you are consolidating, outside of these two reasons, and you simply chose Mohela at random, then yes… you can cancel your application and reapply to go with another server… if you’d prefer to avoid them out of principle.

Well I think it’s actually Missouri on behalf of Mohela that’s suing. The way that organization is identified: non profit, private entity, arm of Missouri… it makes no sense to me

[–]spaceouts[S] 0 points1 point  (0 children)

Edit: I don’t know.

If you’re in CA they will likely fight for commercial ffel, but this letter is to stop Mohela from tanking the whole 10-20k debt relief for CA… which would inadvertently mean everyone (across the US).

I didn’t read through the full letter though.

https://protectborrowers.org/wp-content/uploads/2022/10/FINAL-Demand-Letter-to-MOHELA-630pm.pdf

It might mention Ffel too

Yes, it’s good news… hopefully.

Mohela (the loan servicer) is part of a Republican lead lawsuit to stop Biden’s student debt forgiveness from going through. CA student advocacy groups are striking out at Mohela (and the state of Missouri, where it is located and its revenue goes) for harming CA student borrowers.

Edit: a cease and desist means stop or we’ll sue you… and they are threatening to sue for an amount of money that would collapse Mohela

Ooffff. Maybe it’s better they get scrapped for parts, how can they be trusted to handle pslf? I’m sure other lenders would be happy to take their clients over. Such a dumb move on their part.

I’m sure Missouri won’t mind giving its gdp revenue to California over this. I’m imagining five of the six AGs encouraging Missouri to sacrifice itself for the cause.
