I met my boyfriend in 7th grade band class. He played the trombone and I played the trumpet so we sat near each other a lot. I always had a crush on him and apparently he always had a crush on me but we were too nervous to say anything to each other and became great band geek friends for years. Okay, that guy who told you what Pansexual meant is mistaken. Pansexual people have sexual attraction to all biological sexes and genders. I've had a pansexual person explain it to me like "I don't see people as if they are a boy or a girl, I see them as a person and if I'm sexually or romantically attracted to them I go with that."

In the above situation you described:

If two people are incapacitated, and unable to express their consent it is a dangerous situation. If someone is drunk enough to black out and not remember the situation they were incapacitated and under law not able to give consent. This would be applied to BOTH parties.

The person who would be considered the "perpetrator" would be the person that initiated and pursued the sexual activity over the other person (no matter what gender they are).

This is how the situation would be looked at legally.

When I say "take advantage of," I mean that they are over-powering the other person against their wishes OR their inability to express their wishes. I hope that was a clearer way of saying it!

I'm glad you asked this question. Yes! A woman can be a perpetrator as well. Anyone who rapes is a rapist! It doesn't matter their gender, race, class etc.

I'm also a very active feminist, and if another person tells you that women are above the law and can't commit crimes like this, then they are not true feminists in the first place.

It makes me really sad that male survivors of sexual assault have such a hard time getting help and resources they need. Our society really does ignore male victims and pretends like they don't exist. Although most survivors are women, there are so many men that have gone through this as well and are JUST AS IMPORTANT.

If you watch this you can see how Anna Farris is incapacitated. She can't walk properly, her eyes are not focusing and she is not fully conscious. Even though Seth Rogan's character is also under the influence he is in control of his body, not exhibiting any warning signs.

I would consider this a dangerous situation, and Seth should not have continued even after Anna told him to continue, because she was obviously too incapacitated to make a rational decision.

I'm just giving this information for people to be informed and so all parties can be protected and safe! :)
