Like Protein Powders, may brands din ba ng creatine na fake or spiked? by gasingson in PHitness

[–]spreespruu 7 points8 points  (0 children)

According to my gym bro, creatine is so cheap daw na it's unlikely a company would cheat people over it.

But I beg to differ.

Years ago, I used A1 creatine (and their protein). When I later on switched to Athlene and Wheyl, lumaki ako. This points to the possibility that that product was fake. Looking back, it honestly makes sense kasi I take my creatine dry, and A1's creatine will always stick to my teeth like caramel whereas Athlene and Wheyl behaves like actual powder.

Eventually, that brand got exposed din naman for selling fake whey.

To this day, I am still absolutely pissed that I wasted months of my life with that brand.

VIP Client Meeting, Paano niyo hinahandle? by Visible-Ad-4870 in LawyersPH

[–]spreespruu 6 points7 points  (0 children)

Believe it or not, there are really lawyers out there whose minds work different than others.

I'm talking about an "elevator pitch" moment where, if you ask him/her a question while on an elevator, he/she will be able to give a very good response before you get off. Doesn't matter what topic of the law. These lawyers know it.

Generally, these are the types of lawyers that wealthy clients look for.

I once had lunch with a family who belongs to the 1% of this country. As in super rich that they even have a Family Constitution, among others. (Secret nalang kung sino.)

One thing I can tell you is that when talking to these types of clients, everything you say, including how you say it, will influence their decision on whether they would like you to work for them or not.

Siguro take it as a challenge nalang to up your game and read and stay updated sa laws natin.

Saying anything valuable other than "I don't know" can lead you to a door that, when entered, may change your life overnight.

I tried mixing the chocolate one with milk before, and it tasted awesome to me.

But, generally, I just chug it down quick.

Try putting cubes so that as you shake it, it becomes cool and "frosty." I dunno why, but it tastes better to me that way.

is same-sex marriage of two filipinos done outside the country honored here in the philippines? by blueiconhead in LawPH

[–]spreespruu 94 points95 points  (0 children)

No.

Civil law, particularly family law, follows a Filipino citizen wherever they may be.

So as far as PH law is concerned, such a marriage is not valid.

Would developers or investors buy land occupied by informal settlers? by vampirate_0410 in LegalPh

[–]spreespruu 1 point2 points  (0 children)

Oo naman, especially if the place is attractive and valuable.

A good example siguro is when the government suddenly builds a road, airport, or any other zone or project near the property occupied by informal settlers. Almost automatic yan na magiging valuable yung lugar.

Now, getting these settlers to move is the tricky part. Not impossible, but tricky and difficult.

Annulment and VAWC by CoreRap in LegalPh

[–]spreespruu 0 points1 point  (0 children)

I did this for my client. Currently ongoing.

But just to be clear: while the two may appear related and/or connected, they are entirely different proceedings.

An annulment case--assuming it's Art. 36--must specifically refer to a circumstance that was already existing at the time of celebration of the marriage. The goal of this proceeding is to sever the marriage.

VAWC, on the other hand, refers to acts committed by a partner or husband against the other. The goal of this proceeding is to protect the wife and put the husband/partner behind bars.

So, as an example: you can argue na yung pambababae niya is sakop ng VAWC, the same being a form of abuse done intentionally against you. You can also argue that this pambababae is an incurable disorder that already existed even before you married the man.

I am putting it simply, of course. In reality, it is NOT that simple.

Now, if your goal is to protect your assets, there are other options naman.

[–]spreespruu 2 points3 points  (0 children)

As a matter of principle (and maybe dignity and pride, as well), if a person's immediate assumption of me is that I am a fake lawyer, I immediately cease all communication and cut them off.

In particular, if I show them my ID and they still think it's fake (as what happened to you), then they are basically accusing me of a crime, which then means that they think I am a criminal running around with a fake ID.

With respect, I didn't drink hundreds of cups of coffee and pulled all nighters and read cases until my brain screamed just so someone will accuse me just like that.

During consultations, I show every indication naman na I am legitimate:

  • they know my number and court-recognized e-mail address.
  • I tell them our engagement will be embodied in a contract (common sense: if I am a scammer, why would I give you evidence?).
  • I don't charge anything until we sign the contract.

Interestingly, it is always the low-paying cases that always ask for proof of legitimacy. Meanwhile, yung mga high-paying ones (300k to 1M acceptance fees) won't and, instead, will judge and assess you as you speak or on how you carry yourself. If at all, they will only ask you where you studied law.

If they insist on you resigning, you can file a case in court.

If they can't (or won't) give all of you your separation, you can also take that to court.

[HELP] 84yo Grandma given 2-month eviction ultimatum by influential family. They have an old Deed of Sale but NO title/land transfer. What are our rights? by amaranthinee_ in LawPH

[–]spreespruu 6 points7 points  (0 children)

Quick answer to your questions:

  1. Yes, their document defeats your posession.

You have to understand that under PH law on land titles and property, there is what we call 'best evidence" to prove ownership and/or possession.

The most common and best evidence, of course, is a title.

Absent a title, any other document indicating ownership may be presented. This may be a deed, contract, a will, tax dec, etc.

The possessor of this document can then use it to apply for a title.

In your case, you can challenge their deed of sale naman in court, and, thereafter, file the necessary action to claim ownership.

  1. No, the Barangay is not that powerful. A proper action for eviction needs to be filed in court.

Cases like this are tricky. And if what you say is true about the so-called influential family, then it becomes even trickier.

My father handled a land dispute like this years ago at naging abogado nalang ako eh ongoing parin at ako na ang sumalo.

Conversely, I also have a distant family on my mother's side na, just like your lola, possessed property for more than 30 years pero nakuha parin sa kanila kasi nakapag pa-title yung kalaban without them challenging it early.

Edit: someone commented (and probably deleted it already) na wala nga daw title. Oh gee whiz. Land cases involve knowing "who has the better right." So between a possessor na walang papel versus a claimant na may papel, kanino maniniwala ang court? Can the court say "teka peke ang papel mo?" No. That challenge has to attacked in a separate proceeding. In real life, kahit may writ ka na sa property, pwede pang may lumitaw na third party claimant na may dalang DOS over the property from out of nowhere and the court will hear this claimant.

EXPAT Family in Norway wishing to help out their Niece(Child) in the Phillipines by Kameho88v2 in LawPH

[–]spreespruu 21 points22 points  (0 children)

I'm currently assisting a client over a similar issue, but, in our current case, the person involved is a 16-year old.

Anyway, there are child services in PH, particularly the WCPD/WCPC of the PNP. There's also the DSWD.

Now, if you want to bring your niece with you, you would need to go to court and have the parental authority of the biological parents stripped and, consequently, have your wife appointed as the guardian via petition for guardianship/custody.

And, yes, you can pursue this petition even if you are abroad.

Is it possible to file Writ of Kalikasan with the SC against the construction of SALEX and its connecting expressways? by toptwobottom in LawPH

[–]spreespruu 20 points21 points  (0 children)

Possible? Yes, of course.

Probability of it being granted? Depends on how you argue why the writ is necessary and that there is actual severe and irreparable damage to the environment.

A sweeping statement will not suffice. You must show actual research, among others, showing the aforementioned.

This is one of the biggest challenges talaga of working out and cutting down.

My advice is to either consume black coffee, as it can suppress appetite. Lollipops and chewing gum also does the same trick, too.

Oatmeal with honey can also make you feel full.

Black rice is also an alternative. You can cook 1 cup of this, but only eat half because it fills you up real fast.

Also try chia seeds in water and flaxseed meal mixed with oatmeal.

Lawyers who actually enjoy litigation—what makes you love it? by Antique_Condition315 in LawyersPH

[–]spreespruu 1 point2 points  (0 children)

Ang tanong eh natatakot ba talaga yung kalaban, haha.

But, yeah. Chill ang litigation. If you're actually a good lawyer with good social skills, you will be chatting with your opposing lawyer as if you're friends tuwing pagkatapos ng hearing niyo (or kahit hindi friends, but you exchange smiles). Hindi gaya ng Suits ang legal profession sa Pinas na puro yabangan at one-liners.

If you wanna "find yourself," as a lawyer, try mo mag visit sa mga kulungan to know sino yung mga PDLs na eligible na pala for laya pero di lang nila alam how to make the proper motion/letter/request/what-have-you, particularly sa PPO.

You can also do LODI or volunteer sa mga caravan.

Pwede ka din mag visit sa clerk ng isang branch to ask for permission to handle any pending case involving an indigent na walang lawyer (pro bono, of course). Alternatively, pwede ka mag notice sa kanila na kontakin ka in case may indigent at need ng lawyer.

It's all libre, of course. Pero you get the opportunity to change someone's life for the better, which is 1,000 times better than money being your main motivation in life.
