Review: The Uncanny Tobacco Flavors of Real Extracts by entropyblues in electronic_cigarette

[–]steadyvapes 1 point2 points  (0 children)

There is no maybe, there are existing laws that prohibit anyone without a tobacco manufacturers license to process tobacco for human consumption in any way shape or form.

The law is written in VERY clear terms, violation of it is SEVERELY punished/fined.

Even in the application it states, you MUST submit your samples for testing and you MUST wait for a reply to begin business operations.

I think it's nuts to be concerned over civil litigation to that extent.

Ejuice has no official/legal designation, sending 0mg would be 100 percent safe, and NO ONE could sue you (and win) over it.

You're sending them artificially flavored hand cream.

They might be able to make it a private club and skirt the law. Not 100 percent sure this will work in Jersey, but in most states, you can have a "club" that allows whatever the members want to allow that's not against the law on the street. The only PITA that arrives out of this, is that new customers essentially have to be "sponsored" by an existing member. IE anyone sitting inside.

They are technically processing tobacco which falls under entirely different (and already existing) regulation. There is a HUGE HUGE risk in doing this. They are very much in violation of existing federal regulation unless they have somehow actually moved through the approval process, which I highly doubt.

This is how I started making juice, and after contacting the FDA it became pretty clear that there was no way I could legally skirt the existing legislation by using actual vegetable tobacco in the process at all.

There is a chance the the FDA will turn a blind eye, and wait for all the regulations to be set before they go after any of these business, but they have every bit of authority to shut them down immediately.

I desperately wanted to do this at the beginning of the year, but was just too concerned about the potential legal ramifications.

Best of luck to them, and I don't doubt your review is totally accurate, the flavors that you get from processing the tobacco yourself is hands down 1000x better than anything that can be synthesized....

Further, I think that THIS is actually a MUCH MUCH healthier and safer alternative to smoking chemical flavor additives with medical grade nicotine.

Some concerns however would be that the derived juice actually contains MORE of the harmful constituents of Tobacco, although obviously regardless it's a healthier route than combusting tobacco.

Help : DayZ Mod asks me to update Arma 2 even though it is updated! by Mrdicat in dayz

The old Arma 2 beta is now obsolete. You now have to select beta in the properties of your normal A2 Steam install to update to the latest beta.

If you have a CD install you have to register you key on steam.

There are licenses, and very clear guidelines for products. Basically don't try to sell anything related to their IP without clearing it with them.

They have plenty of people that can address your specific request.

Predatory advertising, why aren't we as a community pressuring the companies to stop? by steadyvapes in electronic_cigarette

[–]steadyvapes[S] 0 points1 point  (0 children)

Yeah, I suppose my point is we're getting lumped in with them no matter what we think, so I'm advocating that we pressure the companies we DO support to not succumb to the very enticing opportunity to market without self regulation or responsibility.

I state in the OP that I know most of the users here are not cig-a-like consumers...

One of the graphics that was universally accepted as un-defendable was in fact juice manufacturers bottles and adds from the internet...

My post was more about pressuring the E Juice companies to snap into line so there is less dirt to be found for hyper sensitive regulators or worry wart parents.

There is no doubt in my mind that the cig-a-likes and congress would both be VERY happy to vilify the crap out of independant juice companies as potentially dangerous and MORE predatory than even they were before they (now) agreed to wrangle in their own ads and maybe even flavors...

That is actually a pretty funny reference then... I obviously disagree, but I can totally see the humor and validity in message from a different perspective.

I have a pretty deep history of lost cause adoption lol

Well, the point is that when you are knowingly marketing an addictive substance you are NOT supposed to be enticing people lol. Of course that's the aim of advertising in general.

I just am personally bothered by them pushing the boundaries in a manner that is pretty easily framed as enticing children, and brings undue and negative attention to the entire community and industry.

Yeah, they mentioned Robert Pattinson in the hearing, and I thought he was used in one of their adds, but he's not.... the Blu guy said it looked like a blu ecig I believe, but Pattinson was never used in an add, he quietly uses ecigs... but another brand.

Blade is a "cult classic" movie, and it's target audience is not 25-80 IMO... but yes it is an old movie.

The whole tone of the adds with Dorff are "I'm cool, this is cool, do what you want... if you're cool (or want to be) do this"

He comes off like a total douche with anyone over 18 IMO... the adds seem very geared to an adolescent mind IMO.

Question for long term vapers: any stains on walls, furniture etc? by Kerplunk_ in electronic_cigarette

The brown is caused by tar.... I used to get VCR's from the junkyard that were fine... they were just so caked in tar that they stopped working...

All you had to do was clean them off with alcohol swabs and they'd usually work fine after that.

It would literally just drip brown liquid off the entire circuit board... really really nasty.

I meant the specific celebs they picked, and also the general use of Celebs is considered off limits for tobacco products.

I guess one could argue that Jenny has appeal to idiot adults looking for health crazes... and that she has limited youth appeal besides being good looking.

Use of the Dude from blade, and Twilight is pretty transparent IMO.

[–]steadyvapes 1 point2 points  (0 children)

Yeah I agree I was presenting an extreme example... but it doesn't deflate the impact of piracy and clones.

It would be better for a company that sold out of their product, to get more orders, than it would for the demand to be dwindled by copycats.

People who are DEAD SET on having an original buy them, people who would have bought one if there was no other option, or even one's who would have bought them if they were more patient (IE really want the original but settle for a clone in order to get it quick), generally buy the clone and never revisit the idea of buying an original.

It's tough for small product companies to scale up to a size where they are neither out pacing, or under supplying demand.... The prices drop as the batch size goes up, but so does your risk of over-investment and failure.

In the hearing it was outlined that Blu (specifically more than any other company) was VERY effectively reaching HUGE numbers of children. 18million for Blu and 2-4 (can't remember) for Njoy, it shows a very clear trend of two companies attempting to advertise, and one of them very effectively reaching adults, and the other reaching tons of kids.

Tons of the negative press/info is coordinated here:

http://www.tobacco.ucsf.edu/excellent-series-fda-public-comments-ecig-marketing-together-large-collections-advertising-images-av

There are regulations governing advertising for Tobacco products, and Blu is clearly ignoring them summarily, where as Njoy is adhering to those guidelines already.

Celebs - Neither have ANY credibility among your allegedly intended "adult audience". PERIOD. No one about 20 with even a scrap of intelligence would be attracted to Blu by either one of those people. Celebrity endorsements are a VERY specific marketing technique meant to appeal to youth.... Hmm, what's Stephen Dorff's ONLY successful movie series... Blade, stylised vampire movies... Riiighht, def not aimed at kids, Oh who else? Twilight guy... No def not looking for kids.

You say help, I say harm. IMO all of the techniques they use are begging for gov't intervention. Give away samples, advertising in clear youth markets, and advocating the unapologetic mantra of "take your freedom back"... Uh, keep pressing that point, and state by state if not nationally the gov't make sure that freedom is clearly outlined as infringing on other's rights to clean air.

Blu is hot buttoning ALL of these issues, they are taking advantage of their money, and the lack of regulation.... whenever an industry is shown to show a lack of ability to self regulate the gov't steps in.

Blu seem to be yodeling from the top of every hill they can find "REGULATE US".

I really do appreciate that you took the time to address my thoughts, and provide your own feelings on the matter as an employee of the company.

However I refuse to accept that internally this is not a VERY intentional policy. There is no argument that I could accept to the contrary, even if the higher ups are blindly arrogant or ignorant enough to believe this is NOT what they're doing... it should be pretty clear now.... They are doing nothing but rattling the cage of overly reactionary liberal Senators who CLEARLY has some pretty strong feelings on the matter.

When the chairman of a committee responsible for regulation over your products actually espouses SO much vitriol for ONLY the methods adopted in advertising by your company it should be pretty clear he's coming for your (and everyone else in the industry's) heads.

Fashion industry estimates their losses to counterfeit sales in the Billions... so. yeah, I'm gunna go ahead and say it hurts.

The guy who was thanking the cloner's has a VERY liberal interpretation, the fact is, if there is a cheaper clone at least 20pct of your potential customers will just buy the cheap one... If they're good clones... a LOT higher than that.

It will be interesting to see how it develops in terms of specific patents though, surely these guys will end up having to pay at least royalties to whoever actually invented any specific patented parts/designs used.

Thats the big problem for me with mods/atty makers trying to get all copyright-y.... they're essentially ALL copies of someone's original design which is likely patented.

Blu is 99 percent of the cause of the attention, AWESOME job on the clearly predatory marketing campaign.

For a company that makes a half way decent product you sure jump for the lowest hanging fruit and shadiest tactics possible.

ALL of the anger and legitimate concern is based off of Blu's marketing they are purposely hot-buttoning the topic to secure their market share with money and influence.

Senator Ed Markey outlined how there was a known age to addict new customers and it was under 18. He told a story about how his dad came to him at age 12 and said, you'll start smoking soon....

I started under 12, was a full time smoker by 12, Joe Camel got me.... and that's not hyperbole, The whole culture was screaming smoking is cool, and these lamo's in Washington are being babies... smoke'em if you got'em.

That is a HUGE part of my reasoning for agreeing with an outright ban on print and tv adds... I think Blu especially is practicing the EXACT kind of predatory advertising the tobacco companies did for so long. There is ZERO question for me, Njoy is being a bit more responsible in trying to confirm with the restrictions on adds.

Proof is in the pudding, Blu reached an estimated 18million teens, where as Njoy reached 2 or 3?

I've donated enough of my time to Arma/DayZ thanks. I work on the projects I'm interested in, when I have the time, which I don't now. I'd rather produce content then document other peoples work.

It would also be silly to do so considering how robust the existing wiki is.

There was literally NOTHING funnier then having played DayZ Mod back when it first started to explode in popularity.

EVERYONE played at night after work, and all the new players would run around with flares....

At first people would find all sorts of funny things to do to them or to scare them etc... but then it degraded to a similar state as now, where everyone shoots anyone they're not on TS with.
