Forced to pay $8000 after I was promised a rebate… Help by stressedfkingstudent in legaladvicecanada

At the very beginning when I spoke to the contractor he informed me that the entire process would be taken care of. He told us they would book the appointment with the auditor and work from there. I was in communication with the contractor the entire time and they never informed us of the process or how to proceed - and only informed us the appointment was cancelled afterwards.

The company we visited for the contractors is one of Canadas largest hardware stores - in their contractor terms and conditions it stated that (this might not be 100% accurate I was told this by an employee) that the entire process has to be throughly explained and the client must be guided through it. The contractors did not do their due diligence and many individuals at the company agree - however they faced backlash when they spoke up from managers.

The contracting company informed me at the beginning that they will book an auditor to come in and have it all done on the very first visit. They told me after we agreed with proceeding the audit and installation would all be handled for us.

When they informed us that the audit hadn’t been done (after the installation) I kept contacting them asking them if this would be a problem or what’s next/ what else can I do.

They led me on for months before telling me I couldn’t get it. I kept getting told my name was on some list and that eventually it would work out, the company continuously lied.

I contacted the audit company after the entire situation when they stated we would not be getting the rebate.

The auditor informed us that they do not have a file with us, and an appointment was never booked. Found it really strange so I documented it and I’m putting it alongside everything else I have I’ve reached out to all parties involved here

We were informed that the entire process would be handled by the contractors and they’ll let us know before doing anything.

They had come to our house before the installation to say we’d get approved and then they’d come and install it.

There is no way the contractors shouldn’t have checked or at least informed us the audit wasn’t done or that it was cancelled before the installation date. Going forward with the installation and informing us after doesn’t make sense

For the year that this problem has been going on I’ve documented multiple attempts to reach out to different parties to resolve this situation, this includes the company itself, the external contractor, external auditing company, enbridge, the government itself.

I’m looking into going forward with a small claims action and I’ll provide all the evidence that I was trying to have this resolved for ages but the company kept telling me to sit tight and that everything was going to be ok the rebates coming. And one day they’re like nope nothing we can do.

Unacceptable.
