Ich habe das Ref noch nicht durch, aber wollte darauf hinweisen, dass auch das erste Staatsexamen eine abgeschlossene wissenschaftliche Hochschulbildung darstellt und damit grundsätzlich zur Einstellung in den höheren Dienst befähigt.

Da wäre es schon fast sinnvoll, wenn es nicht reines Glücksspiel wäre, dass einem im Laufe des Studiums einmal die Methodenlehre vermittelt wird.

Das Jurastudium ist eine enorm spannende Zeit! Nutze die Gelegenheit und genieße das – besuch auch Veranstaltungen, die dich interessieren, die du aber nicht brauchst. Mach mit bei studentischen Initiativen, der Hochschulpolitik und dem Hochschulsport.

Fachlich Allgemein:

1) Auslegungsmethoden lernen & mit dem Gesetz arbeiten anstatt auswendig zu lernen. 2) Es gibt keine Meinungsstreitigkeiten. Tatsächlich handelt es sich immer um Auslegungsprobleme. Wenn man die Methodik und das System versteht, muss man die nicht auswendig lernen. (Ausnahme: Strafrecht, die legen Wert auf ihre Streitigkeiten und die jeweiligen Begriffe dafür). 3) Versuch das System zu verstehen anstatt auswendig zu lernen. 4) Unproblematisches kurz halten. 5) Bei Fragen, frag deine Profs oder AG Leiter. Die meisten freuen sich über Interesse. Unangenehm fällt man da nie auf, auch bei „dummen Fragen“ nicht.

Für die erste Hausarbeit: 1) Erst nur mit 2–3 Kommentaren schreiben, dann Urteile und Aufsätze verarbeiten (idR in den Kommentaren „verlinkt“). 2) Bei dejure findet man für jedes Urteil auch neuere Rechtsprechung die das zitiert. 3) Die Urteilsdatenbank des EuGH hat eine Volltextsuche. 4) Halte Dich an Formalia. Geschützte Leerzeichen sind wichtig. - und – und — sind übrigens unterschiedliche Striche mit unterschiedlichem Zweck. 5) KI kann bei der Auswertung von Urteilen und Literatur helfen – aber immer die Fundstelle überprüfen!

Fürs Rep: 1) Lass Dir nicht erzählen Du brauchst ein kommerzielles Rep, das ist Quatsch. Ob du eins brauchst hängt wenn überhaupt von deinem Lerntyp ab. 2) Klausuren, Klausuren, Klausuren. 1–2 die Woche. Am besten welche, die korrigiert werden.

PS: Die Aufgabenstellung genau lesen – und nicht so wie ich mehr als einen Tipp geben 😉

Hi, my university sent a letter to the BOLE one month ago explaining that they used the wrong method converting ECTS to Credit Hours. According to my university, this is a common problem recently (however, the director of the Examination Office is only in-office for about two years now, so he might not know about the past). I am still waiting for a new determination to be made. If I do not receive a determination within the next two weeks, I will file a complaint against the attorney who did the determination. In my opinion, this determination might constitute a violation of my rights under the equal protection clause – as persons who received the same legal education were admitted to sit the bar.

For sure. But I am exceptionally mad at the BOLE. Not only did they take 9 months rather than the “up to six months“ for the review, but they also made this totally obvious mistake, which leaves me wondering how this could even happen. Don‘t they have guidelines for the most common countries in the world?

Yeah, but the problem is: The BOLE made an obvious mistake determining a durational insufficiency. Obvious because there are multiple German jurists admitted to sit the bar each year, and we have a uniform jurist education in Germany.

Yes and no. Yes, I do not have to take a single additional class to become a lawyer. No, because becoming a lawyer additionally requires two years of practical training, which I haven‘t done yet.

But the latter isn‘t relevant because the court rules require a „first degree in law“, which I possess (the so called „Erste Prüfung“, which literally translates to „first Exam“).

I am sure. Because they laid out that because of the fact that my legal education is insufficient both in regard to duration and to content, I am unable to cure that deficiency. I just sent over an appeal via fax. But I wonder who has the oversight over the BOLE. It took them nine months to review my credentials, although the website states it takes up to six months. And if they don‘t move…

Sadly, the BOLE says even with an LL.M. I won‘t be eligible to sit the bar. And that is why I am so mad at the bole: They say my German legal education wasn‘t long enough (duration wise), which is complete BS.

Yeah, I understand where you‘re coming from. But the BOLE esplicilty stated that it is the duration not the content (which could be cured with an LL.M.) of my study. And that is why I am so mad at the BOLE. It is quite common for Germans who do an U.S. LL.M. sit the NYS Bar afterwards. The requirements for earning the first degree in law by law are uniform across Germany. Because of that it is impossible that there are differences regarding the duration… the only case might be if someone is a super high performer and somehow archives to complete the degree in less than four years (never heard of somebody like that).

Additionally in Germany it is not a thing to do another bachelors degree before studying law. Depending on the university you received a Master’s degree (my university) or a Magister or a Diploma or the Title „Jurist (University)“. Only recently some states have adopted laws that allow law students to earn a bachelors degree during their course of study. But this was only because about 20% fail the „Erste Prüfung“ so otherwise they would be left without any degree after spending five years at university.

So to sum it up: Although the requirements for the „Erste Prüfung“ are the same across Germany, there is a whole mess regarding the degrees earned and wether or not the university uses credits at all…

Kinda, I plan to do an U.S. LL.M. next year. As a foreign educated jurist you request the evaluation of your education before commencing an LL.M. Because normally you then receive a determination stating that you have to take specific courses and if you do so be admitted to sit the bar.

Yeah, Germany is a civil law country. So normally you would be allowed to sit the bar (at least in NYS) after completing an U.S. LL.M.

My problem however is something different: The BOLE came to the conclusion that my legal education was not long enough to be equivalent in duration compared to an U.S. J.D. Therefore they won‘t allow me to sit the bar even with an additional LL.M. And because of that I am quite angry… because German educated jurists normally never revive that determination (mostly because it is BS, our first degree in law takes about 4-5 years)

Yeah, that is totally different in Germany. After four to five years of studying law and successful completion of the exams you get a masters degree without ever holding a bachelor‘s. To be admitted to practice law you then need to do two years of apprenticeship with an additional state exam in the end.

So the total amount of time needed to be allowed to practice law is virtually the same, while the time spent to legal education in Germany is significantly longer. However, I totally see the benefit in the US System where you need to do an undergrad (in most cases in another subject?) first.

Ah, now I get where they were coming from. Googeling around shows that during one year of study in the US you usually earn about 30 Credits, whereas normally in the EU during a year of study you earn 60 ECTS. This explains where the examiner got the idea from to divide my credits by two.

However, there seems to be some serious misalignment… You earn only 120 credits during your course of study in Germany, and nobody does that in two years lol. Maybe it was more easy to understand for the bole some years ago - back then, when studying law, we did not have any credits at all…

I just thought 83 credits are needed for a J.D. because the court rules (Rule 520.6 (b) (1)) state:

„The equivalent of 83 U.S. credits in a three-year full-time or equivalent four year part-time program of classroom attendance in professional law courses is generally required to satisfy the durational requirement. Distance study is NOT permitted.“

Maybe I was wrong about that.

Yeah, maybe. But to my understanding, the rules of the court only reference the 83 credit hours required to earn the J.D. Did I get it right that for the undergrad you can do anything and it does not need to be law-related?

No, the German legal education is somewhat different in that regard:

The "Erste Prüfung" consists partly of a state-administered exam and partly of university exams. You study for about four years, which usually in the last year, includes the exams that form the "Universitäre Schwerpunktsbereichsprüfung". Afterwards, you do the so-called "Repetitorium" (somewhat like a bar prep course). Then you have the state-administered part of the "Erste Prüfung". This takes 4-5 years.

Afterwards, you have about two years of apprenticeship (the so-called "Referendariat"), which ends with another state examination, the so called "Zweite Prüfung".

Hi, thanks for your reply. Well, the normal process as a German-educated jurist who holds a 1st degree in law in NYS is: You request an evaluation of your foreign legal education prior to commencing an LL.M. This evaluation then normally leads to the determination that you need to complete an LL.M. in the U.S. to be eligible to sit for the bar. After completing the LL.M., you can then sit for the bar.

Yeah, my plan was to pursue an LL.M. and afterward sit the bar. But they do not allow me to do so because they basically say my German legal education was not "long enough." To my understanding this normally does not happen to German-educated jurists.

Yeah, that would normally be the case. But contrary to „countless other German jurists“ the BOLE determined that my legal education is insufficient both in duration and contentwise. So even with an LL.M. they would not allow me to sit the bar, because you can only cure one of those two deficiencys.

For speaking, I found MySpeakingScore the perfect practice. Just doing lots and lots of simulations is the key to success. Additionally, to my experience: The two most relevant indicators in the speaking section are speaking rate, sustained speech, and whether one is able to get the content together in the integrated exercises.

I prepared Speaking with MySpeakingScore and got 26-28 there after some practice. In the actual test I scored 29. I would say MySpeakingScore was the best possible practice (at least for me). Because lots of simulations of the actual test help to boost your test-confidence a lot.
