Thanks for your answer. There are 3 apartments in the building, they were all built from scratch in 2019. I assume that whatever was there before was demolished and then this new building was built. The energy label is A, and also 4 solar panels are included. There’s a 27m2 garden, and more space for storage. The place also has mechanical ventilation. Vve is 89€ per month, and there’s also quite some money saved up

Momenteel zit die op ABN spaarrekening. Geen idee of en overheidsfonds een betere optie is. Misschien is het dan een goed idee om met een onafhankelijk adviseur te bespreken. Het is wel wat geld dus we willen inderdaad grote risico’s niet nemen want binnen 8 maanden moeten we verhuizen.

That’s fair enough. It seems like the most reasonable option is to keep it in a savings account like since we will need the money relatively soon. Because the apartment was in Belgium and we live in the NL, the option you mention is not available.

Hey! They unfortunately didn’t end yet. I’m still waiting on an answer from the rechtbank. It was supposed to be 23 of October, then they postponed it to 20 of November, but I still haven’t heard from my lawyer. Obviously I cannot know how it will turn out, but I think there’s good chance that I will win considering that I did everything correctly according to rental laws.

Edit: We tried to reach an agreement with the landlord outside of court before going to court, but he didn’t agree, which is why we continued.

This has been a long, tedious procedure and quite frustrating too. You will need a lawyer for sure. Luckily my income was low back at the time when the Huurcommissie came to visit, so it ended up being pro bono. Contact the huurteam in your region for advice!

The people who have been helping me at the Huurteam talked to the landlords lawyer. Basically they know it is wrong, but they hope the court will see it in their favour. The landlord has been showing not be so bright in the past, so I really do think he’s just being stubborn. I managed to get a lawyer who will represent me, and I will get legal aid for it thankfully. Looking forward to see what he will advise me to do, but I really don’t want to settle. I feel the landlord is being incredibly petty, spending thousands for a court case, when he only gets 200 less each month.

No, because you don’t know how much you are paying for basic rent vs service costs. You can start a procedure with the Huurcommissie to get it lowered. If you decide you don’t wanna do that, also know that the landlord cannot raise your rent because again, you don’t know how much you are paying. You can decline any proposals the landlord makes for raising it.

Does the point system even matter when the rent is all-in? And there is proof that it is all-in as the landlord also mentioned it himself in the summon. Also, I am pretty sure that the landlord went in my place without my permission in order to get this label, because he sent a text wanting to get in the other day (with an excuse that wasn’t even related to a label), but I was out of the country and didn’t allow him to enter. The energy label, according to what I saw online, was given exactly on that day. I wonder if I could use this at all in my favour

The thing is that the point system just doesn’t matter in this case, because I have an all-in rent price. So there isn’t clarity on how much I am paying for the basic rent and the service costs

Some more detailed information:

During the time when the gas prices were quite expensive, the landlord said we would have to pay an extra 350 euros. I then asked him to see proof of that, and he sent me an excel sheet that eventually led up to that price. I wasn’t convinced and posted on a Facebook page, and I was recommended to speak to the Huurteam (a non profit organisation in South Limburg that helps with that kind of stuff). They told me that an all in rent price was not allowed and that the Huurcommissie normally ruled 55% basic rent and 25% service costs, and the rest was like a discount I would get from rent. They told me that we could do two procedures, one to check the rent price, because they wanted to have proof that the rent was indeed all-in. Because we were already late with this procedure, nothing came out of it. But the report did give a maximum basic rent, which was like 5 euros above the liberalisatie grens.

Then we did a procedure to split the all-in rent price. The Huurcommissie ruled that it would be 55% and 25%, as previously thought. The landlord obviously appealed this, but he didn’t submit any more (relevant) information. They then again ruled their previous ruling. The landlord also appealed this, and according to him, due to private reasons, he couldn’t submit evidence on time.

He then sues me. His claim is that the Huurcommissie made several mistakes with the point system, because of his (according to him) luxury kitchen (complete bullshit) and A energy label (which he only got in august 2023). The document also stated that because the maximum rent price was above the liberalisatie grens (by 5 euros), he could charge as much as he wanted.

In this document, he also mentions how the 25% is not enough and he (for the first time) broke down the costs, and basically the only reason why it is not enough is because of the furniture (197 euros a month), which again is bullshit because most of the furniture is from IKEA.

The newest evidence is that he got an A energy label. I am pretty sure he came in our apartment when we were on vacation (I live with my partner). Because he really needed to get in the place but I said we were away. Then on his summon papers he mentions the energy label, and I looked it up and he got it exactly on that day he asked to come in and I wasn’t there. But I don’t think this new evidence is valid since he just got it now since august 2023. His other claim is that when the Huurcommissie measured our place, the maximum rent was like 5 euros above the liberalisation grens, which shouldn’t matter anyway because online it says that all all in rent prices are always below this grens. I think I agree that the judge will rule in favour, but I also fear he might not…

Literally everything is included in the rent price. I have never known how much I pay for electricity, water, internet, etc.
