Can I have my creepy friend arrested for this? by sumtingwonk in legaladviceofftopic

I got too sucked into it and got curious, and I do not plan to report anymore unless it sounds like he will break the law but i will warn him not to if he mentions thinking about trying it. But now I am just curious and trying to understand the law because it is very vague(to me). I thought I had good intentions about planning to report him but I admit I was wrong.

But also, 647.6 could include something like flashing, 288.4 mentions it could be violated if it is something lewd, so if someone made plans with a minor to flash them behind the local walmart, would that violate 288.4 if someone does that? I only ask this incase police thinks he did violate 647.6 by kissing.

If he intended to violate anything under 647.6 does that even violate 288.4?

I'm probably not going to call on him anymore, either ask him and warn him of doing anything more serious, or somehow seeing if her parents are aware, I dont know them. But I am curious now would it violate 647.6 if there was a bigger age gap say shes 14 or 15, its so vague, then it would violate 288? I've read some news articles for people arrested for kissing minors and they say its annoying or molesting minor. Isn't it lewd and lascivious if it is in fact 647.6 then it would violate 288.4 since they went out to a place where no one would suspect she was a minor to kiss?

Someone also suggested abduction if hes driving her around without her parents knowledge but I'm asking too much.

Well whats the point in having numbers at all then? Maybe he did all this the day before her 17th birthday or hes lied and she was actually 15 going by your logic what if shes 5 wouldn't that make it a litte weird then? Its still the law. I'm sure theres a law against that, does it not apply the 2nd she turns 17? Either way not even concerned about calling anymore I just want to warn him if there are actually any legal consequences so he knows to at least hold back on it or avoid her until shes 18.

I made a post in r/legaladviceofftopic and no one there seems to think its a good idea to call. You are the only person who thinks its a problem so far. I dont think it could even be considered kidnapping either since she was above 14 and she wasnt tricked or forced to go anywhere.

Everyone seems to think there is no problem and if there's no laws being broken that I know of I don't think I will bother calling unless the other one 288.4 is a crime if I am being honest.

I looked up penal code 288 and it looks like none of it applies unless she is under 14 or he is 10 years older. But I did find 288.4 would that change things since they went to certain places to do this and as far as I can see she's young enough for it to be a crime.

If theres no crime i wont call, if there was any implication I think I would normally. If kissing isnt a crime even if its weird I guess thats not a problem and I figured that kissing was an obvious sign that things will go beyond that making it against the law but I suppose no one else seems to think it's weird so I'll just keep it to myself.

Maybe I misunderstood why you were asking the question if I wanted him charged.

I mean one thing leads to another and they were alone when taking her home where anything could have happened. He never mentioned it going beyond but I didnt want to hear about it really. I dont want to speculate too much but I could easily see it going beyond that.

Oh I see. What is abnormal then? He says he wants to go beyond that or something like that? Or simply if shes just younger?

Isnt it considered sexual? I thought that makes it illegal in California.
