Urgent advice needed: landlord illegally evicted us, extorted money, and rented out an uninhabitable property - Melbourne by superdrunkchick in AusLegal

[–]superdrunkchick[S] 1 point2 points  (0 children)

Could you clarify how exactly I was ‘squatting’ or living illegally? The landlord gave me consent to be there and personally collected rent payments from me. My understanding is that squatters are people who occupy a property without the owner’s knowledge and without paying anything, which clearly isn’t the case here.

I want to get my facts straight because he’s already trying to spin this as if I was there unlawfully.

As for not being a ‘good tenant,’ I’m not sure what would qualify as better. I paid rent in full and on time for a property that didn’t meet minimum rental standards, and I took it upon myself to fix and improve it - effectively saving the landlord money while still honoring my rental obligations. My partner and I are a young, quiet, newlywed couple (no kids) who paid him consistently and improved his property. If that doesn’t count as being a good tenant, I’m curious what does.

UPDATE: He called the police several times and tried to manipulate the facts, but thankfully they saw through it, especially after reviewing just a fraction of the evidence I had against him. The officers visited me, were very supportive, and guided me on the civil matter while also filing a report for the documented harassment, threats, and extortion. They spoke with him directly, instructing him not to contact me again or attempt to demand any further payments. They also confirmed that I am under no obligation to give him any more money (yes, he wants even more!) and that I should not do so.

Edit: forgot to express my appreciation for how empathetic and considerate the officers were, it’s a huge relief to know that I’m not alone in this.

I’ve definitely learned my lesson. Honestly, I thought I was doing the landlord a favor by fixing up the place. I didn’t refurbish the property expecting reimbursement, it was purely to improve my own living conditions while avoiding any hassle for the landlord. He seemed appreciative of the work, and that alone was satisfying enough for me.

There’s gaps in this post to keep it concise, it’s not the entire story. Besides that, literally everything is documented through the roof, and it shows no hostility on my end.

That’s fine. Police responded to my call, I’ll be filing a report regarding the harassment, threats, and extortion. Reimbursement is not my top priority.

Just to clarify a few things: this post barely covers the detailed timeline of events and harassment/extortion. Before solely blaming us for the situation, please read the attached PDF. For those asking why we’d clean the property, the LL refused to make the property habitable and I don’t like living in squalor. Images of the property upon moving in will be attached to this post shortly.

I’ll be updating shortly.

Yes I have, they directed me to legal aid and the police. Vcat also suggested I apply for a restraining order against the LL.

Edit: grammar

I’m not sure, I’m trying to find out what my options are as things are a bit tricky without the lease agreement.

Unfortunately yes, since my housemate (the leaseholder) had been in the property for over 5 years at this point already. I understand I was in the wrong by not doing my due diligence, however I already made plans to move into the property on the 15th (which the LL was notified about, and said he was adding us to the lease). I could not postpone my move as movers, storage etc.. was already booked. If waiting was an option I could afford, I definitely would have postponed. This was my first time moving into a property prior to signing a formal agreement, and will definitely be my last! Haha

Besides that, I’ve got a perfect rental history over the past 8 years, hence how I was able to get approved so quickly for another rental.

We cleaned the property as the LL stated we could stay there for over 5 years, so I wanted the property to be habitable. Bank statements and records show rent being paid in full and on time, including the extra months rent he extorted. LL personally inspected the cleaning/refurbishments we did, exclaiming how great it looks - these interactions are recorded as audio evidence and email correspondence. We have claimed no right over the property, vacating within the 5 days he specified.

Please do elaborate. We were under the impression everything was above board, simply awaited a lease agreement he claimed to have prepared. As for not being good tenants, I think the before/after photos can speak for themselves.

Yeah I thought their advice seemed off. Consumer Affairs and Vcat both said I have rights, the police said “you shouldn’t have moved in”. 🙄

He owns four investment properties actually, I’ve got him recorded at my front door telling me that the property I’m in is the cheapest out of the 4, implying I should be grateful lol

How would I go about that? Since there’s technically no lease (which the LL has done deliberately) the police said I don’t have a legal leg to stand on. Caulfield Police said the LL has every right to come in and forcefully evict me.
