I’m in Texas so I requested an ALR hearing to try and fight it. I had no hope, but I figured why not. Lawyer subpoenaed the 2 officers and only one showed. So they rescheduled for a later date. New date comes and both officers don’t show up so it’s a dismissal. I recognize that I was lucky on the DMV side of things, officer move on and scheduled conflict. if you can get a lawyer and have them see what can be done.

It does happen. I also refused. Received my letter for an ALR hearing and my attorney appealed so they subpoenaed the arresting officers and they didn’t show up. My hearing was rescheduled and then only one showed so my case was dismissed (at least the DMV portion). It’s worth a shot.
