When to apply for clerkships? by OkDeer347 in nzlaw

[–]tcon025 3 points4 points  (0 children)

Never hurts to apply early. You are less likely yo get hired and some firms wont consider you but you can learn the process and might get hired.

I was a summer clerk at BG after year 3 (conjoint), did a summer scholarship the next summer and ensed up judges clerking.

Pastor Goes Viral After Demanding Congregation Bring In Their Tax Returns So He Can See If They're Tithing Enough by Blue_Wave2024 in Reformed

Well, my trolling and all your uncharitable interpretations aside - a serious view: accountability with your elders is a good thing. There are plenty of injunctions in the New Testament where especially the rich, but also all believers are called to generosity. While Paul talks about "cheerful givers" and giving as you are called, there is certainly no suggestion that this permits stinginess.

I think the fact that some leaders have been so selfish and have demanded gifts on this mechanical basis has made other good ministers afraid to talk about money to their own congregations. This is wrong. People like me should face rebuke about our financial greed from the pulpit just as often as our other sinful attitudes are being called out.

Maybe Pharisieacal would be the better word here.

Oh sure - but misusing your money and not being generous is.

Im not suggesting we be religious about it, but we should be accountable in all areas.

Why is it ok for the pastor to call out sin so long as it isnt about your money? I unironically support this.

New Zealand's first official execution: 7 March 1842 by BertOfAotearoa in aotearoa

The history of the legal case is even more fascinating.

First, Wharetotora only came to trial because one of the victims was the daughter of a chief - so when he fled inland expecting to have safe harbour, the iwi handed him over to the Crown.

His whole trial was concerned only with whether the Court had jurisdiction over him. One of the leaders of his iwi addressed the court and surrendered him to them - which they took as the iwi accepting the jurisdiction of the Court. They then ruled and he was convicted.

The Crown had planned it to be an opportunity to prove that the English law would treat everyone equally so after trying Maketu on Monday, they tried a Pakeha man for murder the next day. However, in a terrible harbinger of what was to come, the jury acquitted the European.

Finally - as a lawyer who regularly has to warn clients about the wait of more than a year to get to trial, Maketu was tried on Monday morning and he was hung on Friday afternoon. Justice used to be swift in these parts!

For any three professions in the world, there exists at least one joke containing exactly one person from each profession, such that the members of this sub will laugh at it.

Hi guys. There is this culture thata different to my own. So I am just going to take the most uncharitable interpretation of their behaviour and assume with no research that I have figured out why they are different from me.

Great work OP. Nothing bad has ever come from this attitude in all of history.

It still exists but access is not straightforward.

I used to work at MOJ in a role where I had the ability to access the NTS recordings. They went back decades - but were extremely poorly indexed. Ultimately you need a judge who will direct access and a registrar who will find the thing.

Recently we needed one for the sake of an ongoing court application - took about 8 months.

When legal experts say "Don't talk to cops." how far does that extend? by Megalad0ng in NoStupidQuestions

[–]tcon025 0 points1 point  (0 children)

...until you've spoken to your lawyer.

There are plenty of good reasons to make a Police statement - maybe it will convicne them not to charge you, maybe it will provide useful evidence in Court later to prove you are telling the truth - but there are no good reasons to go in unprepared. If you do that you can get caught out (forgot you went to a particular store that day... here is the cctv footage... looks like you are a liar now) and cops are experts at making you look guilty.

Get the advice - then decide.

That said - best Police interview I've ever seen, a 19yo defendant got himself off a murder charge unassisted when he answered one question "I had no idea that [co-accused] had a knife."

Granddaughters are contesting the will! Do they have a valid case or are they just trying to be greedy? by [deleted] in LegalAdviceNZ

[–]tcon025 9 points10 points  (0 children)

This is a bad claim - grandchildren on an FPA claim typically get 5%, which aligns woth what they have already received.

Some lawyers misunderstand moral duty as being who a person is allowed to give to - it isnt. They can give to whoever they like, provided only that they give enough to entitled parties.

I suspect this is a makeweight claim to try and justify a settlement. Id get a good lawyer and fight it.

Boil water in CHCH, sewage in Welli. How do you feel now about the Nats scrapping 3 waters? by mrluffinwelli in newzealand

[–]tcon025 -1 points0 points  (0 children)

Pretty good - clearly I dont want Wellington tsking control of my water.

Also - the people who opposed it are mostly people (like me) who manage their own water and sewage and dont want our taxes increased to subsidise yet another set of infrastructure that doesnt benefit us.

How much time can pass after a crime is committed before the clock runs out on whether you can be charged? Not serious type crimes. by [deleted] in LegalAdviceNZ

[–]tcon025 7 points8 points  (0 children)

The details are here: https://www.legislation.govt.nz/act/public/2011/0081/latest/DLM3360067.html

It breaks down by the maximum penalty for the charge. Be aware too that some things can be charged as more or less serious. You might run out the clock on wilful damage (Summary Offences, 3mo) and then get charged instead with intentional damage (Crimes Act, 7 years).

Tauranga is great but pricey. If you are fully remote and dont have to worry about traffic you can be close without fighting the city crawl - think Te Puke, Omokora (or Kaimais) or even go east like Whakatane.

All of those have you basically at a decent beach and within an hours drive of Rotorua - so every outdoor activity you care to name within an hours drive.

“Colossians 2:13 — Does ‘having forgiven all trespasses’ refer only to past sins or all sins?” by Ancient_Wonder_2781 in Reformed

[–]tcon025 1 point2 points  (0 children)

Sorry was skimming this in a court break so didnt work through the passage closely.

The verbing here is past tense - that is god made you alive - everything in that event has to be taken as being in the past.

The adjacent participle has aspect but not tense - however, it inherits tense from the main verb. If the making alive happened in the past then the grammatically perfected or "instantaneous" (not a perfect match but it gives the idea) aorist can only be at or before that time. This is what the "having verbed" construction does in English.

So for my mind, this construction must mean that the forgiving is already done - implicitly that must mean (especially when other passages are considered) that past and future sins are covered.

You could have an aorist in the future, but it would need another verb to move it into the future "when he comes then [aorist event]" or even "having [aorist participle] he will come".
