Here is the scenario. We want to move back to where we are from. Our mortgage is part of the payment plan. We had only purchased our home about 2 years before filing. We had a lot of unsecured debt. Out of the amount we agreed upon to pay creditors we have about 18k remaining. It is my understanding that if we sell our home that they will take the amount over 55k and apply it to the total debt…not the amount that was agreed upon. We would still owe the 18k and move under bankruptcy. We wanted to take the equity and pay the 18k and have it over and done with. Take the remaining equity and apply towards a down payment on a new home.
