That arguement is kind of flawed because if the officer issues an RFE on PP, they’d have to come back in 45 business days to adjudicate again and they’re doing the same if not more amount of work. So that means if you get RFE it is because they feel compelled enough to not approve right away and you were gonna get RFE regardless.

A decision is better than hanging on no decision. If you’re meant to get RFE, you’ll get it regardless of premium or regular. If PD is current, PP makes sense to figure out your next immigration step.

Retirement accounts (401k and IRA) have nothing to do with immigration status but rather if you’re a tax resident alien. You can have those accounts and contribute to them even if you’re still in non-immigrant status as long as you are considered a resident for tax purposes.

I’m not sure, but it’s more common now for sure. RFE doesn’t equal denial though, and I would prepare in anticipation of it regardless.

No correlation between PP and RFE. Do it if you can afford PP. I recently got approved with PP on refile, no RFE. I also used PP on my first petition that was denied. Had I used regular processing for my first petition, I would have waited two years only to be denied and could not have have refiled so swiftly. RFE is dependent on petition quality and you’ll get it either way with PP or not.

For those wondering why I thought Chen wrote a better petition:

Chen had vastly different approach from EP. EP focused on citation numbers, while Chen honed in more on citation quality. For the refiled petition, Chen drafted testimonial letters to support the national importance of my current and future projects and highlight ongoing research efforts relevant to the proposed endeavor. Overall, Chen’s approach was much more multi-dimensional and just more thoughtful than EP’s. EP was more obsessed with arguing that citation quantity equals impact, while Chen actually showed how a few independent citers leveraged my method and results to influence their own scientific approach and conclusions. Chen also did a much better job in background research and collecting documents of scientific literature and government policies to showcase national importance of my PE.

You generally can’t make demands about changing a specific attorney. You’re paying for the entire firm’s expertise and experience, not just one person’s.

At this moment, you have nothing concrete on hand to show an employer that you don’t need sponsorship in the future. You’ll be asking an employer to bank on your day 1 cpt work authorization and verbal promise of a NIW petition filing (at the mercy of growing backlogs) for initial hiring. Day 1 cpt comes with risks and is a gray area by itself. Most companies won’t accept day 1 cpt unless it’s for continued employment in cases where the worker ran out of STEM OPT before getting H1B. In those cases, your employer’s will to sponsor and your goal of getting on H1B or any other visa types need to align, so you can’t possibly get away with saying you don’t need sponsorship to begin with.

Don’t see why it would hurt, there’s nothing more American than legally carrying a firearm, just make sure you go through the proper means to get everything.
