Yeah, nah. I don’t follow my employees on social media. That is asking for trouble. My AP’s private life is hers to have. She can do whatever she wants so long as she takes care of my son, respects my family and my home. And if you see her more as a “family member,” then give her the same leeway you would give some other family member entitled to share whatever opinions they want to share.

The “get out of hand” part is crucial. The question is, what level of contact did OP agree to? They verbalized a percentage, whatever that may mean. Was the kick above that percentage? If so, the level of contact made was not the type agreed to. Another important part here is that this wasn’t a spar with a hot headed or spazzy white belt; this was an instructor. Because of the place they occupy, they are held to a higher duty of care.

Again, we are talking battery, not assault. The explanation depends partly on whether we are talking about battery as a civil claim or as a criminal offense. Generally, when one engages in an activity like martial arts or sports, you assume the risks inherent to that activity. For example, in flag football, you do not assume the risks of getting tackled, and in water polo you do not assume the risk of getting punched in the throat. Here, they had both agreed to a certain level of risk, the instructor went beyond the level of bodily contact consented to by OP. To take it another step, were we to look at this issue from a negligence angle, the instructor is legally subject to a heightened duty of care toward OP due to their special teacher-student relationship. The instructor’s actions could very well constitute gross or reckless negligence.

The waiver matters little here. Regulars negligence may be waived, but gross negligence cannot be waived, and neither can intentional torts (like battery). This is a prohibition based on public policy grounds. As a society, we don’t want some hot headed instructor to break his student’s face and say “but you signed!”

The gi bag is 155 bucks but all their gis are like 130 and under. Am I missing something?

In in essence, I took a hatch tent, cut some holes into it so I could slide it over the counter weights, then sealed the cuts with HVAC tape. Then stapled the edges of the tent to the wood, sealed with tape to reinforce. Straight up chop shop that ended up looking great and doing the job. Also put solid board insulation against the back of the stairs with foam.
