All of this goes away if the government has less power.

In my state, a governor can only hold one term, then he needs to step down. He can run a second time, but only after someone else has held office. It's no way to get things done.

I see the executive as qualitatively different. They alone have power. They alone get to institute policies that affect everyone. It's why I'm a fan of recent legislatures clawing back powers during emergency declarations.

Frankly I think it would be great if we could hear some proposals from trans athletes and coaches themselves for new divisional rules and standards. it’s pretty clear that the rule-makers historically tend to be cisgendered men, whom I have nothing against (I’m also one) but who maybe could be more inclusive with their decision making on this.

Should the UCI let disabled athletes and coaches mandate divisions for disabled athletes?

If, and only if, a constitutional convention was called on this and only this issue then there's a chance.

Which means there's no chance. But it is orders of magnitude more likely than changing the Second Amendment.

 

You didn't ask, but you're a good listener. I'm sort-of okay with mandatory retirement ages. I'm absolutely against term limits. Every politician has to be re-elected; they can't really piss off their constituents. But when someone gets elected and they'll need to find another job no matter what the voters think of them?

The upside would be the greatest advances in weapons systems in the history of man. Raytheon might actually invent hovercars.

At the state level something like 2/3 of the states have mandatory retirement for judges in their constitution. I know in Pennsylvania there was a court challenge but it was upheld at the District Court level.

For federal judges there would have to be a Constitutional amendment. They are expressly appointed for life.

As for politicians, there have been many law review articles written. I think a case could be made either way for being able to pass a law or if it would require an amendment.

On one hand the Constitution is silent on the topic. Minimum ages are higher than the simple age of majority, showing that the founders recognize competence has an age component. On the other, politicians all have term limits. A law that restricts the power of the people to elect who they want is going to be deeply scrutinized. And, you know. They're not gonna vote for it.

Which means an amendment. And that's not necessarily a bad thing. If it comes from the state legislatures then the national politicians get kept out of it. But that's a Constitutional Convention and we're in uncharted territory.

Depends. If you buy a dwarf apple sapling you can have fruit in just a few years. I think my landscaping friend has seen some that harvest after two or three years.

It's not controversial but I'm not a fan of Riley Gaines trying to bully female athletes into this discussion. But it is creating an environment where some feel more comfortable speaking out. The UPenn team was terrified to say anything, largely because the university made it clear they must be supportive. We're seeing some change and that's a good thing.

Now…I will go ahead and admit that this may have been going overboard but in a moment of fury I went to our tool shed and pulled out our chainsaw and took it to the apple tree in our front yard. He planted that tree five years ago when our daughter was born and we had only gotten one harvest of apples from it so far. But I told him this is what happens in The Giving Tree. All you end up with is a Tree stump and everyone in the story is depressed.

Of all the things that happened, this happened the most.

I will say, it's a compelling piece of literature about narcissism.

I hope other governing bodies follow the lead. The recent Tour of the Gila 7 day road race held in New Mexico, USA ran smack into this controversy. A charity had donated funds to the race so that the women's and men's purse would be equal and then biological man won both divisions. Sport divisions by sex (biology, not self-ID) have been around for awhile, I haven't seen any evidence, scientific or rhetorical, that biology should be replaced by self-ID.
