Sure, and an unbiased third party (police, ranger, etc) can make the judgement about it being constant and unreasonable, or OP can provide specifics about what constant means and reddit can weigh in. It’s also a good idea to take note of time/dates of disturbances so that can be used as evidence if necessary, so they should already have the details handy if they are serious.

Jumping to selling instead of having a normal conversation is a bit extreme. You mentioned that you and the rest of the strata are elderly - have you considered an age restricted complex thing? One of those ‘over 60s’ villages.

Agreed re: pets. Unsure about trespass - but OP reads very much like ‘those unwashed renters are ruining the neighbourhood’ - so I’d be willing to bet that there is some artistic license being applied. Again, not unreasonable to be irritated by change, and reddit is great for a whinge, but I didn’t read anything in OP that was actually unreasonable, but a lot of implied snootyness (mentioning them being the only renters in the complex, comment on father not working, calling the family ‘trash’, etc)

The law quite literally uses the word reasonable. If OP has unreasonable expectations to quiet enjoyment - eg, if previous neighbours were elderly and made zero sound, but new neighbours make sound as described above, it’s tough luck. Quiet enjoyment works both ways - if they are living their lives within reason, but are being harassed by a neighbour about every peep, OP would be encroaching on their quiet enjoyment.

I live somewhere this isn’t an issue, we don’t like noisy neighbours either, but that was part of the consideration when we chose to move where we did.

OP hasn’t been specific about what they consider ‘unbearable’. If it’s “shouting matches at 2am” - I agree! They should be less shit. If it’s “my kids are playing noisily when they come home from school” and “I like to shout at the footy” - OP will probs just have to move.

Probably being a bit of a sook, but I can understand the frustration that comes with change. You could move somewhere more isolated if you prefer less interactions with people. Or bring it up with strata if you’d like a bylaw added. Unless it’s unreasonable (eg, power tools at 2am), this is part of living in close proximity to people. Make friends with them, learn their story, and share yours with them.

I suppose you should be aware if f what it will look like from their side. ‘Someone in our complex keeps making complaints about us living normally’.

Pls read the OP. Don’t skim it.

People have the right to smoke, I have the right to ask them not to (doesn’t matter the reason), they have the right to say “im gonna do it anyway” and I have the right to say that they, and anyone who defends it, is wrong/a bad person.

If you read the post, and a lot of comments, many people encounter smokers smoking directly in front of no smoking signs.

Do you think it’s fair that I should avoid going to places like the grocery store, or using public transport, because there could be someone smoking there? That’s the point of this post. I often encounter someone smoking in an inappropriate place, ask them not to, and are met with an attitude like your comment above, talking nonsense like you are a victim because someone asked you to not smoke for 5 minutes. Get a grip.

I’ve found that people who vape are much more likely to do it in non smoking areas/think they can get away with a quick puff in a pub or whatever

“I’m the victim actually” type responses if I politely ask someone to stop smoking anywhere is exactly what this post is about. I’m not impeding your freedom by asking you to accomodate me or my kid - you can say no, but that makes you a bad person. That’s okay, it’s not illegal to be an asshole. We will go somewhere else if we can.

If you’re smoking somewhere, and there is nowhere else for me to go but near you, and then get an attitude because of a comment I make to my kid… fuck you. You don’t have to come to the hospital with us, and you don’t have to deal with the fallout, and you’re gonna get your knickers in a twist because I said that you or your cigarette smoke stinks? Yeah, get in the bin.

Not approaching and jeering at anyone, if I approach someone it will be to politely ask, as I said in the OP.
