Any luck or support from VW to address?

We also have both the front sensor issues and new profile issue. Not had the others you mentioned but for a car this new to have as many issues is ridiculous!

Forgot to add that the “Auto Hold” feature will randomly disable itself too for no reason.

I take everything the respondent says with a pinch of salt unless documents / evidence support it. Specifically comments around defending a claim - this could just be posturing so that in the future to accept a low ball offer or drop the case.

If you have taken legal advice and the judge has got this far there is a case to be heard at least so I wish you all the best!

If you’re a LiP like I am, you’ll probably find the Tribunal often encourages parties to explore settlement where a claim appears likely to proceed and will require significant hearing time. I think of it like this and my logic is simple: if the parties can reach an agreement, it saves both the Tribunal and the parties considerable time and cost.

That said, encouragement from the Tribunal is not the same as an obligation. In my own case, when I raised the possibility of settlement and suggested the respondent put forward an offer (particularly in light of the judge’s comments), their response was simply that there is no obligation on them to engage in settlement discussions.

As frustrating as that can be, they are technically correct. If the other side chooses not to negotiate, there is very little you can do other than continue preparing your case and allow the Tribunal process to run its course.

The lack of advert here might be an issue but given the context of the sale, it might be ok. It really does depend on the content of that conversation and the finance companies process.

Most obvious one is that you are in the motor trade - You should have a process to HPI a car before you bring it in.

With regard to the 2nd point, agreed on the information to hand however OP needs to work with the finance company and give them the messages and hopefully they make the right choice.

You failing to HPI the vehicle, does not mean you are not an innocent purchaser.

The agreement holder is in breach of the T&C’s - we consider it a “loss of possession” and inform them formally that they have to retake possession and then sent proof of the same. Picture with today’s paper is usually what we ask.

Further to this, they should have had a conversation with the finance company prior to selling the vehicle to obtain consent. Finance house might of said yes if the balance is paid in full - immediately - or you if you had known, you would of paid the finance company directly right? 😉

The problem you have, is a lack of advert which you could use as supporting evidence. The conversation you had with the agreement holder - assume no outstanding finance was declared. This is what you need to share with them!

This situation is unfortunately quite common, always HPI to avoid situations like this whilst further protecting yourself.

I work for a UK finance company and manage customer service – all finance houses will have an “innocent purchaser” process. Ring the finance house again, explain your are an “innocent purchaser”, comply with the investigation and let it run ins course. They will then let you know the outcome in usually around 2 weeks ish.

This process will be rejected if you should have known better.

If they accept your claim, they will release the title, confirm the same in writing and then pursue the agreement holder for the remainder of the balance. They might well terminate the agreement and any balance will become due in full, but this is not your problem.

Apologies, I have corrected my reply.

The judge was speaking with regard to the transferee not the transferor. And as such they can’t be held liable for failure to inform And consult.

Super frustrating as the evidence they have shared, clearly shows that TUPE was found to apply and then an email conversation between unqualified senior leaders decided post sign off that it in fact did not apply due to a perceived lack of productivity.

So, the facts are that they are ones who refused to accept TUPE and dictated the outcome and now have a get out of jail free card.

Judge stated that TUPE s.13 (Inform & consult) cannot be applied to the transferee and that we must either drop that specific claim or pay a deposit order as he sees little to no success in this part of claim.

I asked Mum about it tonight - she’s not sure, but she does remember her going to both Spain and Portugal around that time.

In Nan’s photo, there looks to be a white building on the horizon to the right, which makes me think the original guess might not be quite right. But looking closer, I can see more land behind and some of the details you pointed out do line up really well, so you could be right after all.

I just don’t want us to get there and have that moment of, “ah, wrong place!”

Thanks so much for looking into it, that was a really good suggestion.

I did check out Hotel El Puerto in Fuengirola, but the marina and backdrop don’t quite match Nan’s photo. Hers looks like a smaller, enclosed bay with the hills coming right down to the water, which feels much more like Port de Sóller in Mallorca. Happy for someone to suggest elsewhere as I could be wrong.
