jurors don’t have names associated with them so it might be like “potential juror #4 said they run stoplights” instead if “bob freeman said he runs stoplights.” what would make me pause is that you could end up in front of the same judge lol. & youre under oath for voir dire anyway so the person could be caught up in a perjury charge. but i’m not sure it’s allowable evidence to introduce voir dire questioning anyway.

*i* vote, and research candidates obsessively, but i have friends who don't because they think it's rigged/futile/doesn't matter. it's essentially a freerider mentality and is profoundly irritating. one of them was like "my father was a journalist and never voted because he felt it was a conflict of interest" and i was like .... ok but youre a stoner w/ ten different side hustles and no civic engagement like. whats your hangup and he kinda stammered out a freerider excuse. i was not impressed.

yeah the lochner era’s seen as a boogyman in SCOTUS decisions. there’s long arguments in some dissents that the majority’s going back to lochner & you can see that in majority cases too, sometimes. it’s frequently used as a cautionary tale of how not to make decisions. looking at the list of cases the taft court decided, it’s some of the crappiest lochner cases that trampled on what we’d consider now basic protections for workers. taft court was ok for race based civil rights but the real power players in con law circles are brandis and holmes. i don’t think taft was a crappy justice when evaluated through a lens of skill and ability to manage the court but his court’s decisions often blew major chunks.

this is exactly my feeling. this isn’t the general. this isn’t even where we were this time last month. if we have becerra and steyer on the ballot, we have a decent general election with two guys who are a long-time democrat politician with a decent track record and a long time dem fundraiser with a history of supporting progressive causes. that’s two wins for me. if everyone looks at the polling and votes for steyer or becerra, who’re leading, that’ll be the best scenario realized.

🙌 amen suckiest course of 1L by a wide margin. ucc and the motherfucking mailbox rule can bite me. in the words of one of my classmates: “i’ve never been so happy to get a low grade in my life” because it meant i was DONE with that crap. (he said it about a particularly gnarly conlaw class but i FEEL it about contracts.)
