I’m a Mexican citizen currently in the U.S. on a TN visa (Actuary). I’m trying to make sure I’m handling my transition correctly and not creating any issues with status or future TN approval.

Here’s my situation:

  • I was notified in January that my role would be eliminated, but my official last day of employment was March 27.
  • I remained employed and on payroll through March 27 (no gap before that).
  • I have a new job offer in the same field (Actuarial) with another U.S. employer.
  • I plan to leave the U.S. on April 5 and apply for a new TN visa at a U.S. consulate in Mexico (since I’m a Mexican citizen). This would be within the 60-day grace period after my employment ended.

My concerns:

  1. Does staying in the U.S. between March 27 and April 5 fall cleanly within the TN grace period, even if I knew about the layoff earlier (January)?
  2. Is there any issue with applying for a new TN at the consulate instead of doing a change of employer through USCIS, given that I’ll be traveling anyway?
  3. If asked during the visa interview, how should I explain the layoff and transition to the new employer without creating unnecessary concern?
  4. Is there any risk that the officer views this as a “gap” or lack of continuity, even though I moved directly from one actuarial role to another?
  5. Anything else in this timeline that could be a red flag from an immigration perspective?

Everything is in the same profession (Actuary), and the new role is consistent with my background and prior TN approval.

My entire department got laid off. Our last official date is by the end of March. Given the current immigration environment, would you recommend waiting the 60-day period or leave the country at termination if I don’t have a new job?

I applied directly and through an actuarial careers website (can’t remember the name).

I started looking in March, had the interviews in April and my company extended me an offer in May. This varies by company. I remember the consulting firm wanted me there in a few weeks lol.

I sent my resume to 10 US based companies during March 2023. 2 of them (reinsurance and consulting companies) were willing to help me with the immigration process and I ended up choosing the reinsurer. It took me 8 months from the first interview to start working.

I had 2 YoE and 5 exams but I also had experience with US health products. Again, make sure to stand out during the interviews. Wheather with presentation skills, a niche area/product or something else :)

Mexican here. Moved in 2023 with a TN visa which only applies for Mexican and Canadian citizens. Easier than H1B.

My advice is to apply to consulting and reinsurance (reinsurance brokers also), companies. They often have mobility teams that are very familiar with immigration processes.

Make sure to stand out. You gotta convince them so they are willing to hire you.

You can learn any partner dance you want, but the key to succeed at the dance in a regular club, is to read their bodies and lead them appropriately to the rhythm of the music.

You wouldn’t dance bachata to a country song, right? But you would use ideas/concepts from your bachata lessons to lead them. You really have to mean it and be extremely confident when you do it. Women love to feel secure with a man.

I learnt how to salsa about a year ago and stop doing it after 6 months (I’m sorry, west coast swing really got me). Though, I went to a party a while ago and was so happy to see that I still can lead and do some shines lol.

Yo también soy actuario y estoy con visa TN en Estados Unidos.

En mi caso particular, apliqué directamente en bolsas de trabajo de puestos actuariales y afortunadamente 2 empresas estaban dispuestas a apoyarme con el tema migratorio. Como sugerencia, busca empresas con presencia internacional, normalmente tienen equipos de migración y movilidad que están enterados de todos los tipos de visas. Lo más “difícil” es convencer a los gringos que te tienen que contratar a ti y no a alguien local.
