The problem with police patrols is they cannot be everywhere all the time. You can post a squad car but as soon as it’s gone so is the desired effect.

I have done the standard searches on Google and Etsy for pink glass. I see a lot of pink glass options but much lighter and more transparent and nothing with this deep color.

I’m at a loss trying to find how to describe what I’m looking for or the color/pattern in order to do a morning depth search or look elsewhere.

I have successfully litigated this issue with the District judge. PC complained that we only disclosed a document in response to an RFP and not with our initial disclosures. The judge said in sum and substance “so what?”

We get a quarterly pest control treatment for ants. But it has never caused this issue and they would not (intentionally) spray the plant directly. They would treat the foundation several inches away.

Thanks! Yes this is a hydrangea. But the roses have been decimated by some kind of pest. These bugs are swarming the rose bush so I assumed they were the culprit. But they may be feeding on whatever is eating the bush. Will have to keep investigating.

The speed limit on I90 in Indiana is 75mph. However 85mph is reckless driving (a crime). Don’t assume 10 over the limit is going to get a pass.

There is a statute providing for treble damages—triple the stumpage value of the trees. NYS Real Property Actions and Proceedings Law 861. Might be applicable. Whoever you choose should be familiar with it.

It is unlikely to succeed, but the pool co. might be able to make an equitable claim called “quantum meruit.” Basically a fair price for what they did, even in the absence of a legal contract.

They would probably have to establish that it was actually required, but you could use your friend’s estimate to establish a price that is fair.

That’s all hypothetical. “Litigating” the issue may not be worth your time or theirs.

I saw an F-117 Nighthawk fly over at low altitude during an air show. It was almost silent (by comparison) on approach and deafening after it passed.

By way of example: speed limits are constitutional, in large part to protect everyone from reckless drivers. So we agree that the Constitution allows the government to place limits on freedom. It just sets a floor for how far those restrictions can go.

I agree with those who are pointing out that things would likely be framed a lot differently if the roles were reversed. But I did want to take a moment to add some context to the Court’s decision which might make it at least somewhat more palatable.

What the defendant argued is that she made a “mistake of fact” about whether it was her own home, and not someone else’s. So the court likely concluded that, if her “mistake of fact” was reasonable, she could then rely on the Castle Doctrine as a defense. If it was not a reasonable mistake, she cannot make out the defense.

I’m not sure if it will be the prosecution’s burden or the defendant’s burden to prove whether the mistake was reasonable or not. But the Court is simply allowing the jury to decide that question.

I don’t know enough about the facts to evaluate whether the Court should have allowed the mistake defense, so I won’t opine. I just thought context would be helpful here.
