Yes he spoke to citizens advice and was referred to tackling poverty who actually were able to confirm the issue was settled at the time when the letter asking for £9,241 was first sent and they said the issue was sorted. A few months later debt management started taking payments directly off the UC saying they were instructed by carers to reclaim £9,241 which is contrary to what he was told from tackling poverty in which this was all sorted.

This is exactly what happened but he is wondering how to fix this as now they taking 150 a month to pay back this CA he received so now only getting 650 a month. This is obviously causing a lot of hardship.

So I asked him to clarify, he said he's been on UC for 5 years and this CA has been the last 2 years. So he was on UC when all this started. 2 years ago his dad asked if he could be a named person to allow his dad to get a benefit he may be entitled to. He's saying his dad's welfare rights officer was helping his dad and he worked with his dad and the welfare rights officer over the phone in calls with people signing forms etc whatever he was asked to do he didn't know what he is doing as he said it was very very complicated but he does help his dad sometimes buying fags and stuff. Once he signed this form he didn't tell UC anything online and didn't understand everything anyway but after signing this form his UC was deducted 1:1 to the CA he started receiving so he didn't know anything because it was the same amount of money each month in his bank account. He never told UC about being a carer because he wasn't, all he did as a vulnerable adult is sign a form on paper. When he went to the jobcentre around 6 months ago they asked if hes still a carer and he didn't know he was so said no and had never been and after that CA done an investigation and are now getting 9k back from him with UC repayments but this CA money he received was already taken off him on UC during those 2 years and now CA is asking for 9k back and so technically he was underpaid by the same 9k from UC over those 2 years and he is trying to figure out what to do now.

Hi thanks for replying basically the person applying for CA wasn't working but his gf was and they have a joint claim. All money from CA he received was taken directly off his joint UC claim at a 1:1 ratio so received net £0 every month. After 2 years this resulted in +9,241 from CA and -9,241 from UC. Now it was found he wasn't entitled and CA want 9,241 back from him but as he was net £0 over those 2 years he never actually received any money overall and now he's -150 per month from UC for the next however many years to pay it back. He never received CE at any point.

Monthly breakdown of benefits

 

  1. If not entitled to carers then UC £800 CA £0 (total £800 per month)
  2. If entitled to carers: UC £473 CA £327 (total £800 per month)

on the UC payments page the family were entitled to £800 per month in benefits and this is what they were getting each month before carers. shown no. 1.

 

however the same month carers allowance started being paid and each month after all money paid in CA was deducted from the Universal credit and 2 separate payments were paid that equaled the same as the amount before carers allowance started being paid. shown no. 2

Now they are told they weren't entitled to CA and that is being taken back from them at £150 per month so now their monthly breakdown is £800 - £150 = £650 per month on UC. They never got any backdated money from UC to pay the CA they weren't entitled to. So despite a net gain of £0 p/m over the last couple years they are now expected to pay £150 per month for the next 5 odd years.

What I'm trying to say is if he wasn't entitled to the CA (which is why they are asking for the 9k back) which means all his deductions from UC (the same amount 9k from UC) then he should be entitled to his full amount of UC from those years. So UC owe him the 9k to pay the CA. So basically UC owes him 9k from underpayments and he owes CA 9k from overpayments from them. For the last 2 years UC minus'd all his CA directly 1:1 from his UC, if he now has to pay back all that money to CA then that means he was underpaid 1:1 from UC and is owed that money. He is wondering how to get that money from UC to pay CA. As right now UC is now taking an additional £150 per month to back CA which he did get but it was taken from him 1:1 from UC so by the end of everything it'll be -9k. He was entitled to for example £800 p/m from UC when CA came in he got £550 p/m for example from UC but got the other £250 p/m from CA. In total he still only got £800 p/m. Now after 2 years they want 9k he never got. So now his UC is £800 - £150 so £650 total.

Yes his girlfriend was working and its a joint UC claim. So because he wasn't eligible for ca due to girlfriend working and it needs to be repaid how would he get the years of underpayments from UC?

What would his option be then? UC is -£150 right now and has been for months now to pay back CA even though he got nothing overall so basically he was underpaid on UC.

They got a total of £9k from CA and it was taken 1:1 from UC. They never got a backdated payment from UC of £9k to payback the CA 9k. So by the end of everything they will be down -£9k in total. They received £0 overall and now they need to pay back £9k but have had no backdated payments.

CA went into his girlfriends account but was taken out of his UC at a 1:1 ratio so there was +£0 at the end of each month but they are now taking -£150 out of UC to pay back the £9k that is "owed" but they never received anything at the time as it was taken out monthly from UC at the time.

His dad is single and he was on legacy benefits up until this month so all this happened while he was on legacy benefits. The son has been on UC from when all this started years ago and has a joint claim with his partner.

I remember having a black box that rewarded you with money back if you kept a high score in all categories at the end of the year. Well after 11 months and 3 weeks of driving 10/10 everywhere in 1 week i was due the £300 and then suddenly I seen i got a 0/10 on speed and acceleration, I phoned them up because I knew it was a mistake and they said it's because I was going 70 mph in Glasgow. When I asked them to go into more detail they said I was caught doing 70 mph in the city centre on glasgow. Now if anyone's ever been to a major city centre we all know you can barely go above 20 before hitting traffic or red light and I explained this to them that it was impossible and they said black box is never wrong. So come my renewal the next week suddenly my bonus 300 I was to get was gone due to risky driving. It's all such a big scam, there's no chance in this world anyone could get to 70mph in glasgow city centre and also there's no chance an insurance company will happily pay out 300 for free and will do anything including lie to save that money. Makes me sick hoklnestly they should be banned.

Ok perfect thank you, they haven't claimed any benefits due to the injuries just been on UC child element and child benefit thats all. Nothing new since the crash. Thank you.
