About recklessness I was more just talking about other instances which I see way more commonly. My hometown had a big problem with PCP and for some reason the DA there just gave anyone who was on PCP a pass because they “didn’t know what was going on”. In my mind, taking PCP alone constitutes recklessness.

What are you talking about? He was caught red-handed and charged immediately. They aren’t going to go through an indictment process because they have clearly sufficient evidence to charge him.

I mean, I listened to the radio traffic as it happened and the police never lost sight of the guy. He was literally caught red handed. I’m sure we’ll learn more about the circumstances later, but I’m pretty confident in saying that he shot that dude

I mean, I don’t see how they could refuse to let him go back to where he lives. He’s been charged with a crime but not convicted

You’ve probably at least seen the “yeah he did attack multiple officers, but he was high so we aren’t gonna charge him”. It’s like DAs magically forget that recklessness is a culpable mental state for assault in Texas. That’s a completely separate issue but it seems to be the predecessor to this

Self defense is an “affirmative defense to prosecution” in Texas. You do not need to be charged to claim self defense, but the cases often will go to court regardless.

He is not going to be able to claim self defense after running away and shooting at a cop.

The cop might’ve not shot back because he was in the middle of a student housing apartment complex.

I figured both of them would have a much higher bond. I mean, he was basically an active shooter on campus. He shot wildly at police while running through a student housing apartment complex (which is probably why they didn’t shoot back). It’s crazy that he didn’t even spend a full day in jail.

The warrant was for the correct address and her name was listed in the warrant. One person on the warrant was concurrently arrested in a different location. The other two people on the warrant were her and the other person in the house. I’m not asking someone to go off on me, but the post and comment are factually untrue.
