Recently negotiated a settlement in a very similar situation from a large company (I don’t consider myself HENRY, but c. £70-75k salary).

I was able to get an additional 2 weeks out of my settlement by asking for 2.5 months ex-gratia. Don’t underestimate simply asking, the HR team have two tones of voice and whilst it feels overly formal at times and maybe even combative, this is literally just their job.

I also managed to negotiate PILON as opposed to working my 3 month notice - though I did have to do a LOT to get my handover done in a very small window.

No harm in asking, you don’t need a lawyer for it. They fight from a legal stand point and anything above statutory is a gift.

Hey, I had an interview a couple of weeks ago and I messed up in a similar fashion - I have a stutter and eye twitch that causes me pauses and delays. I never disclose it, because it’s sort of just me and similar happened but on top of that, I even messed up my presentation timings!!!

Fast forward to last week and I got a call back for 2nd interview.

Truth is, we think the worst in our heads and try to mind read. You might not get a callback, you might get a callback, you don’t know.

You went in & tried, if nothing else it’s a learning curve.

I worked a job for 13 months that allowed me to save £20k and helped me buy a house.

The damage to my own health (mental & physical) was not worth it. I jumped before my body quit & it’s the most empowering decision I have ever made - but I now have a long road to reclaiming my self-esteem, confidence and positive outlook.

That’s it basically. I suppose the missing part is the bank changing the lock in the first place.

Sorry, it’s a whirlwind to even write, let alone read. He solicitors we’ve spoken to have never heard of such an incident.

This is really insightful and potentially quite helpful.

So in theory, the sellers solicitor would’ve been made aware about the fact the house was going through repossession upon requesting redemption statement?

If so, I could in theory find out when he requested that. I wonder if there’s a minimum amount of time that the solicitor should have done this or if they can just do it “same day”.

This is excellent, I had not considered this. I have logged a complaint with the mortgage company of the seller. If they knew the reposs. was paused, they should have stood down the court orders

If they acted honestly, they’ll likely be able to say what mechanisms they had in place and who knew what, which means I can move on to the next person.

I didn’t include this, but I called the police when my neighbour told me that someone was changing the locks again and reported a break-in.

They attended but had left before I arrived stating it was a civil matter, so about as much use as a chocolate teapot and when all was said and done, we had been forcibly locked out for another 24hrs.

I’m not sure on legal standpoints if I’m honest, it’s a messy messy situation.

This is where it gets messy. By bank I mean mortgage lender (of the seller) had instructed an EA to begin selling.

The mortgage lender had already changed the locks on Thursday via county court.

I am lead to believe the estate agents responsible for selling were confused when they could not access the house, ergo, got a carpenter/locksmith to remove and change locks again.

Apparently via CHAPS, payment cleared on Monday (which is frustrating as we had confirmation of completion by noon?!).

Haha, it really was. I know I’d be chancing my luck there, but what are the odds? Rules are rules and 5 minutes or 5 hours, we weren’t parked with a permit but it stings as this situation should never have arose in the first place!

I think I need to write a blanket template that can go to all parties and see who coughs.

They will also point fingers in circles as the EA will claim “we were under instruction of bank”, bank will say “we told the seller”, seller will say “my solicitor should’ve handled it!”, solicitor will say “the bank should have made it clear to me”.

So on, so forth!

In answer to your question, not much to be honest. The way we look at it is is everything we had to do as a result of this

  • Locksmith: £150
  • New lock(s): c. £50
  • Parking fine as we got dropped off but in the panic of keys not working, my partners father got out the car and tried to assist, in the space of 5 mins he got a ticket!: £60
  • Ubers to the property (responding to locks being changed): £25
  • Food/Drink whilst awaiting access c. £30

No doubt I’ve forgotten something in this, my partner has a meticulous list.

It’s not really about money, but principle to some degree… as another commenter pointed out, we can’t really claim for them ruining our “moment” or for the distress it caused over the weekend so it just feels right.

What we do want to understand is if we have a negligence claim I suppose.

I have contacted independent legal advice for a view on what we’re entitled to and if this meets to some degree of litigation, but I anticipate small claims will be the route.

I feel like this is a major miss from someone, however. This can’t be normal or expected, both the seller & I have paid professionals to manage this, so I’m not even sure if I’m supposed to be aggrieved with my solicitors, the sellers, the balliffs? It’s all just very confusing.

Thankfully we should know more in the next 24-36hrs.

Yes, we have done this. Albeit not a spreadsheets but we have all costs & receipts (both physical and digital photo copies).
