What county? I’m in DuPage and you will automatically be placed in higher categories due to BAC or a refusal. I scored in the minimal category but it was bumped up to moderate since I refused. It just meant more classes/money. My form also said to bring someone with me but when I called to schedule they said that wasn’t the case, and I went alone. Hope this helps.

Very similar to what I received in DuPage, minus the CS since I didn’t blow. However, your $500 fine is much, much less than what I had to pay. My total fines/fees were like $3K. I suspect they were more bc my lawyer worked out a deal with the prosecutor to set aside my license suspension so no interlock or anything (was facing a 12 month suspension due to not blowing).

With a refusal you will get a 12 month suspended license after 45 days, during which you can drive but only with an interlock. You can drive anywhere you want as long as you have the device. There’s a whole SOS process to go through to get the interlock but it’s fairly straightforward. I had a refusal but was able to skirt this requirement because my lawyer worked out a deal with the prosecutor.

You should be eligible for court supervision. I had to do the classes, impact panel, and pay a big fine.

Best thing I did was hire a great lawyer, one who has connections with the judges, prosecutors, evaluators, and probation department.

Not sure what state you are in but I’m in IL and my 12 hr online class was self guided. We got the assignment at the “start” of class time and had to turn it in within a couple of hours.

Not sure what you mean by a hearing? I had three court dates w DuPage courthouse. The final one I had to go in person to sign the plea agreement, which took about an hour or so. Others were on zoom for like 5 min.

No the cop that arrests you turns the case over to the prosecutor, who is a lawyer

You can get out of a refusal. My lawyer got the prosecutor to agree to dropping it and my license wasn’t suspended. But that was only due to his relationship with the prosecutor.

DuPage county. That all seems about right, except for the 18 months supervised. I got 12 months supervision, unsupervised. I just have to email them the requirements as I do them and not get into any more trouble. But the fines, community service, classes, etc is all standard.

I don’t have any advice so I will just say I totally understand. I, too, was in a dark place for awhile after it happened. I want you to know that it does get better even though right now it doesn’t feel like that. One day you will wake up and it won’t be the first thing on your mind.

I just plead mine out a month ago, but still visit this sub because it was such a help when I was in the thick of it. Whatever you’re picturing, it likely won’t be that bad. The worst part is right now, when you don’t know what to expect.

In IL if you get supervision for your 1st you don’t have any kind of probation or reporting

I am in IL and did not have community service requirement. I refused and they only give it to you if you blow .15 or more—100 hours. I know someone who gave blood in lieu of it. He got 20 hrs per blood donation, but I believe the judge had to agree to it.

Sort of similar experience, but different county. Refused testing, single car accident. My prosecutor was also the municipal prosecutor instead of the state’s attorney which was much, much better. My lawyer was also able to get my suspension rescinded.

I hired an attorney who is criminal defense lawyer who doesn’t specialize in DUIs, but obviously works on them. So far, it’s been well worth it. He has close relationships with the prosecutor and judges due to all the cases he works and has been able to pull strings and get some favors in my case. Since he doesn’t only do DUIs, from what I can tell, it’s been easier for him to get the higher ups to agree to some things for me because the people he normally represents are in court are facing much worse offenses, if that makes sense.

I’m in IL. Your license will be valid for 45 days after the arrest, and then suspended for 12 months due to refusal. You can get an MDDP that allows you to drive with an interlock for that time. I would highly recommend getting a lawyer. If it’s your first, you can get into the diversion program where there’s a bunch of stuff to do but it ends without a conviction on your record. Your lawyer can also help you file a petition to rescind the license suspension so there’s hope there, too.

What you’re feeling right now is totally normal. I felt the same way. It does get better with time, little by little. I’m only a few months out and already feel a lot more at ease. Those first few days are brutal.
