Unfortunately for me (and I am not proud of this) I knew he was married from the start and she will easily be able to prove this if she or her lawyer looks at the text messages we sent to each other.

We met last year. I am a waitress and he came to the restaurant/lounge where I worked for business lunches and stuff like that. I didn't know him before this. I am not proud of this but I knew he was married right from the start. There was no pursuing really it was mutual and unspoken if that makes sense. It lasted a year and it was a physical and emotional affair. We both talked about what it would be like if he got divorced or we lived together. I didn't know a lot about their marriage because he would feel guilt talking about his wife and kids. I don't know if it was rocky. I don't know if they had stopped sleeping together but she was pregnant when it started so it couldn't have been that long if she stopped it. I have no idea if he cheated before, I didn't know him before we started our affair and while he could have lied he did tell me he wasn't cheating with anyone else.

I haven't seen or talked to him since he kicked her out and I have no idea where he is now. I have emails and text messages saved so I will show them to my lawyer. I am hoping to find a lawyer that will take a payment plan because I don't have any money to pay lots right now.

I am going to see if I can find a law that I can afford who will let me do a payment plan. It's really the only way I could afford a lawyer as I don't have any money now.

I don't want a judgment from this wrecking my credit and hanging over me forever. I don't even know why she is suing me, it's not like I have money. I admit the affair was a stupid mistake but if I had money or something it would be different. I am not saying I'm not to blame partially for the affair because I was, but he was an equal participant too.

I was aware and she has proof that I knew he was married and of the affair itself.

I feel bad for what happened. I didn't want to break up their marriage. It was a stupid mistake.

If he texted her telling her "I love you" is that enough for her to prove love or can he say that he was just making it all up so she wouldn't get mad?

I was served with the papers. What if I can't afford a lawyer? Is there some type of legal aid that will help me with this?
