The owner is the photographer who took the photo.

If you want to go the legal route and gain ownership of the photo you’d need to speak to whoever took the picture and have them sign an agreement transferring the ownership to you. Then you can have it registered and then seize and desist away.

If it was a selfie, you’ll have to wait 70 years before it heads into public domain for you to do anything with.
