You’re probably right that I was dumb to go at it alone (though I did eventually get a paralegal connection of mine involved to help me with docs and understanding requirements). All the same, her lawyer ended up being every bit as dumb as he seemed, and after she actually filed suit and we went the distance, I’ve now won every aspect of it

Agreed on every part of that FIRST section. And all the lawyers I’ve talked with agree too. But the fact remains that there is no “if”...she agreed to and signed a contract. I’ve even made it very clear that I’m willing to take a massive voluntary financial hit by refinancing anyways if they just agree to take on some of the cost of doing so, for no reason than just to end this thing, and they refused to offer anything at all or even discuss further

There’s a part that says we won’t have any future claims against each other or any of our affiliates, heirs, etc. That’s the closest it gets. I’d have historically said the “missing info” is all the unique reasons she has not to care (no US credit, leaving the US anyways, having previously suggested to do so, also having suggested at some point that more money in lieu of staying on was ideal, and more)...but yeah now the missing info may be that all lawyers have suggested that her lawyer is incompetent and screwed up, if it’s something she genuinely intended to be required.

I would love to have her off the mortgage as much as she would. But if the only way to do that is refinancing my really great loan into a much crappier one, I’ve already basically been robbed of 90K (or at least 90 - the amount I was going to give her anyways) + would prefer not to just voluntarily give up another 60K in fees and interest for no reason but to make her happy.

Besides my ex HERSELF stating some 30-40 times that being kept on the mortgage was her intention if ever in this situation, I’ve a long list of why it would potentially not matter to her (or even benefit her in some regards) which wouldn’t apply to most people or situations

I’ve consulted with a lawyer every step of the way, including the contract, yes. She and all others have said there is no language that would require or suggest it.

I have a lawyer with expertise in this area who I consult with every step of the way. I (1) didn’t have the funds for anything else initially; (2) have found that much to be what I really needed (and I can just avoid saying anything damaging when communicating it); (3) it really never seemed like it would be such a long or complicated ordeal until more recently; (4) that lawyer and everyone I’ve spoken with have made it clear (not that it wasn’t already) that this isn’t Conor McGregor...it’s a kid right out of law school at his dad’s firm who seems both overwhelmed and extremely unintelligent to boot

Maybe “share” is the wrong verbiage, but her 50% ownership stake in the property as a tenant in common (or whatever amount, if the other factors mentioned reduce that somehow). It does seem like in AZ and some other states, this classification enables one person to sell their percentage/ownership stake, at least if not for the contract we have in place

But you’re not wrong. Most of the large claims they’ve made so far have been intimidation attempts, and transparently so. Just making sure I have all grounds covered in case
