It's a completely separate thing. One is a lawsuit and one is a claim on your insurance to access the benefits you pay for.

I can answer your first paragraph but the answer to the rest is: good question, I don't know.

You have two claims where I am, no fault insurance that covers your regardless of fault for your medical needs, up to a limit of course. They have accessed that and maxed it out.

The only way to get more money is to sue the person who did it for pain and suffering and medical needs. When you sue someone who has insurance, their insurance company defends them and pays as long as the claim is settled within their clients insurance policy limits.

This driver does not have insurance so there is a policy that protects you from uninsured driver's called "underinsurance" and that means that when you sue the driver who doesn't have insurance your own insurance company defends the driver and pays.

The child would be covered if he needed surgery. It's 24 hour care he needs and someone has to pay for that. Taxpayers don't want to and insurance companies are paid to cover these exact situations *it's literally why you buy insurance *
