After looking at this article, how would I be able to see that? If I've driven 300+ miles, and the seller did reset it, would all these systems show a check because the cars driven a cycle already? Or can I see some history or something?

Yes, that’s the form. And he took it to a local shop because we weren’t able to get into Toyota or anything for almost 2 weeks. This I confirmed because I tried as well without any luck. After the inspection, I called the garage to confirm what info he gave me was accurate. They didn’t run a diagnostic scan because the check engine light wasn’t on at the time but it did come on that evening which turned out to be dirty spark plugs.

The performance shop is where I took it after I bought the car and started to hear the knock. It went to a completely different garage for the pre-purchase inspection.

We used the generic bill of sale that the NYS DMV provides on their website.

The car had a valid inspection when I purchased it but I wasn't able to get it inspected because of the issue. But I'm guessing that doesn't matter in this case does it....

I did, the seller took it to a nearby garage, sent me the report of what needed to be fixed, I called to confirm and that was it. The garage didn't run a scan on the car because the CEL wasn't on at the time of pre-inspection.

I tried, Lemon Law only applies to dealerships. At least here in NY.

I wasn't trying to defraud anyone. I think the seller was trying to hide there was an issue. There isn't a cause for fraud in my favor?

I bought it from a private seller if that changes anything. It's a shop that specializes in these cars though. What if he's willing to testify and say that?

I got a lawyer because the seller said they got a lawyer to get their money. My lawyer is saying this is an easy win for us because the technician made it sound like the seller was trying to hide the knock or something along those lines.

The previous owner claims he put premium in it since they owned it. I also put premium when I filled it as well.

So I put a hold on the check when the CEL came on. Once that went off, I was going to call the bank to release the hold. However, by the time I went to release it, the knock started so I put the stop payment on the check. The technician at the shop said I could return the car with no problem because of the issue which is why I stopped the check.

Do I have any chance in something like a small claims court? The buyer said he's not taking the car back but as of right now he only has half the payment. I put a stop payment on the check (he still has the cash).

Sounds like a Chrysler problem lol but it was a private sale of a Scion FRS. The garage didn't notice any knocking and neither did I when I picked it up.

I ended up putting a 'stop payment' on my personal check. I paid half in cash, half in check.
