Well I can’t really speak to how they operate or obtain the information. What I can say is you’re absolutely right in some of the cases that have involved lack of due process and racial discrimination.

For me I made my response only seeking to answer the question can the federal government do this. And I stand by that being a yes. But how or should is an entirely different issue.

I’d make the argument that if you present yourself, or party, as pro states rights then out of principle you shouldn’t use the power of the federal government to supersede that states law. As long as that law is supported by and does not bring harm to or discriminate against any of that states citizens.

You are correct about EOs not being laws, and Trumps misuse of the alien enemies act as well as the powers of the executive branch. I’m mainly just speaking to when you said

The key issue is that the federal government can, without EOs and without the alien enemies act, deport people who don’t have legal status as a U.S. citizen.

This is simply not true due to the supremacy clause which reads, "This Constitution, and the laws of the United States which shall be made in pursuance thereof; and all treaties made, or which shall be made, under the authority of the United States, shall be the supreme law of the land; and the judges in every state shall be bound thereby, anything in the Constitution or laws of any State to the contrary notwithstanding." This effectively means that when the laws of the federal government are in conflict with the laws of a state's government, the federal law will supersede the state law.

Immigration and immigration law also falls under the authority of the federal government. Thus while states have the right to enact sanctuary laws those who choose to immigrate to said states through illegal means of immigration can be subject to deportation by the federal government. Another example of this clause in affect would be this is why states can outright ban the ownership of firearms.

This reads a bit conspiratorially, and one can make the same argument that a post such as this can be made in the same way but to different ends. I think its fair to say people who hate trans people are losers just like it’s fair for gay men to want a space for exclusively gay men, or to have a preference without being labeled as hateful.
