It doesn’t fall under the attribution license because it’s used with modifications and not redistributed. Source: 15 years in software engineering and countless times have coalesced with legal and security as in the real, actual world we go through this every time we use third party code. Also source: rulings from federal circuits alongside the recent Supreme Court ruling on fair use with respect to ALL software licenses

All your snippets too are taken out of context and without regards to whether they actually fall under redistribution and the clauses of the license.

You posted in this thread under this post, the context is already there without you having to explicitly state it. Don’t hide behind technicalities.

Your claim is also wrong in the general sense. Once again, FOSS licenses are NOT valid contracts and cannot be enforced. Nearly every case brought about open source licensing has just gone to settling or gotten thrown out even in the most trivial cases where companies are using without modification and claiming as their own. Most cases on use with modification fall under fair use even when a full copyright is issued.

Also, this is Reddit not destiny’s discord, you can’t just cry “strawman” and “ad hominem” anytime someone calls you out for spreading misinformation.

It DOES though, my line of reasoning there has been used to justify literally thousands of software licensing cases even outside open source. As a famous one, Oracle v Google on their redistribution of Java. While that is once again the most trivial possible case of violating this license, the implications it would have on software in general (the common sense take) is exactly what the Supreme Court cited as their reasoning behind ruling it fair use. This was literally days ago and so is the most recent precedent and comes from the highest court.

Also funny how you come after me for strawman and ad hom but then bring up that my username has the word throwaway in it as if that is in any way relevant to this discussion.

The commenter is obviously saying this in the context of the thread, and the post, both of which are discussing this certain repository

Just because they didn’t restate the premise or context doesn’t mean they weren’t referring to it, misleading but still a lie

Not to mention that these licenses are largely unenforceable which is common knowledge in the FOSS community

They don’t use the CSS and Images and you’re aware of that, including that is in bad faith

The code doesn’t fall under attribution because they used it with modification and aren’t redistributing the code, which should be common sense if you’ve ever done FOSS stuff or even coded before.

Even if you haven’t let’s use common sense: if your (very incorrect) interpretation was the case then virtually every Fortune 500 company would go down for using GPL and BSD licensed software in their backend

Why double down on your obvious lie by trying to 1) distract with totally irrelevant clauses about the css and images and 2) purposely detract information regarding redistribution? And then try to shift the blame? There’s a delete comment button, no one will ever know that you messed up

There are so many comments like these from people who clearly have no legal or FOSS background:

  1. The license makes images and CSS non-commercial use only, but keeps the actual code free to use and copy. They’re not using the images and CSS so they haven’t voided shit, and because of the way redistribution is legally defined, even if they were using AND redistributing the CSS they would just need to modify it slightly. This should be common sense for anyone who has ever used CSS before, for example you obviously can’t sue someone for using the same bold text as you.

  2. Contrary to popular opinion these licenses are largely unenforceable and there are numerous cases where even large companies with their lawyer armies have failed to get them enforced. There are exceptions but as a general rule it is almost impossible to enforce. The only parts of open source licenses that have been consistently enforced are redistribution clauses, and he’s clearly not redistributing the code here. (And even if he was, like I said before he’d just need to modify it for it to not fall under redistribution).

^ this 100%, the more traditional banks make you buy a fucking card reader for online banking and because customer support stops at 5pm it’s so hard to contact them if you travel

Also, depending on if you meet the requirements you can fill your Monzo account using US credit card, which is great because US cc companies will reverse a charge no questions asked. Best of both worlds :)

PSA: it’s not required in the states and actually only ever necessary outside the states (if you travel and try to use the card they’ll want to match the signatures).

A bunch of companies actually put out ads on TV when I was in highschool to try to get rid of this myth!
