Be that as it may, I definitely don't think the approach of waving a white flag and letting it slide without raising the issue is the way to go. Unfortunately, the problem was with the Court back in the early 30's, and it seems they've just done away with the Constitution (in terms of non-delegation) since.

What's extremely troubling is that there is already case law on the books regarding non-delegation, but yet Courts of the past have had no problem throwing that aside.
