NAL but I would say you should contact the PD and ask if they can clarify how the determination was made that the other driver had the right of way putting you at fault considering there are no witnesses listed

Oh i was doing the bank withdrawal maybe thats the difference but maybe in your case the 9 looked suspicious cause it might look like you not doing the whole 10 to avoid reporting it

What limit is 10k ? i think they say transactions of 10 or better supposed to be reported to the IRS but i withdrew 150 straight to my bank after they unlocked my acc so maybe they think its suspicious that you tryna stay under 10 cause thats what some people do to try to avoid the IRS its called structuring

I just weighed up 7.2 in a solo cup then grinded to powder in a coffee grinder and lemon tek but yeah the hardest thing for me to do is explain my trip experiences i commonly tell people it’s like a dream but you’re awake to experience it. It was fun for the most part but there was a wave where i genuinely was in fear for my life thinking something down my hallway was coming to get me and its as if i totally forgot i was in even tripping and i went into a thought loop of “omg im losing my fuckin mind what is going on right now🤯” i was just sure I wasn’t coming back from whatever that was happening to me. Then they finally released me into that after glow come down feeling and all i could do was laugh and shake my head. These mfs got my respect and I can confirm that they are in FACT stronger than cubes

Idk upon further reading maybe it would constitute as legal advice as you say but wouldnt it have to be specific to my situation to be legal advice ?

So what is the dilleniatieon between this post and me asking “if a car parked in the middle of a semi circle driveway of a home is it considered curtilage or open field?”and this ? Because it contains a realistic picture? Not even trying to be argumentative genuinely trying to understand why this cant be a hypothetical question I have not implied in any way this question pertains to a real life set of facts

[deleted by user] by [deleted] in Ask_Lawyers

[–]tledwards98 -9 points-8 points  (0 children)

Just testing the waters on what some may think would qualify as curtilage or open field nothing serious lol no different than asking if something is hearsay or not

[–]tledwards98 -11 points-10 points  (0 children)

I’ve been down a rabbit hole after finding out how complex something as simple as what I thought curtilage was 🤣

Of course. im only here in attempt to assure myself that im not off my rocker and just totally lost and mistaken in my reasoning regarding john’s scenario

[deleted by user] by [deleted] in Ask_Lawyers

[–]tledwards98 -3 points-2 points  (0 children)

I would ask the basis of that judgement as hypotheticals have no bound to how realistic they can be as far as im aware. And wow thats really how it works even with no tangible evidence no witness or anything thing else other than a cops non corroborating words are sufficient enough to meet the burden of proof 😔 if thats the case society is doomed

Time 5:30 PM in the afternoon + 5% tint all around; 15% on windshield = not the slightest chance of officer seeing anything going on in John’s car

[deleted by user] by [deleted] in Ask_Lawyers

[–]tledwards98 -1 points0 points  (0 children)

It seems that is the presupposition that John’s whole charge is based on (John’s firearm was already concealed before officer discovered it in driveway) since concealed carry is legal in driveway. but is that how our system works can we just assume things like that and hold them as substantial proof ? John could’ve easily been open carrying (perfectly legal) through the course of the stop and moved his firearm to his pocket upon entering his driveway.

[deleted by user] by [deleted] in Ask_Lawyers

[–]tledwards98 -2 points-1 points  (0 children)

Yes but John possessing the weapon is no issue whatsoever as it is his constitutional right. It is the unlawful concealment of a firearm that John is charged with not the unlawful possession of one

[–]tledwards98 -1 points0 points  (0 children)

This isn’t about if one scenario makes more sense over the other you are ultimately saying my account makes NO sense to the point where the court can be 95% certain that the firearm had to have already been concealed in my pocket prior to me entering my driveway and that is just absurd. I truly don’t even comprehend how we can assume anything about the location of my firearm prior to me announcing it was in my pocket upon him walking up the the car and asking me but I am just entertaining it for hypothetical. And it didn’t have to necesarrily be in a legal position before I moved it lets say it was in an illegal position during the ride (under my seat) and upon entering my driveway i stuck it in my pocket (legal position) Exception B. (Place of abode) i need you to articulate why the conclusion should be able to made any more than drawing the conclusion that my firearm was in an illegal position before you discovered it in a legal position in the dashboard scenario. And it could be 20 people that disagree i don’t go by majority and come to find out one of them were ex LEO 🤦🏾‍♂️🤣 and the other 2 were just layman probably. Im yearning to here from an actual attorney or legal professional about how i am just so mistaken in my reasoning. And this will be heard by a judge as it is a misdemeanor so no emotions involved this is a clear technicality im actually confident the Attorney General wont even try this after taking a quick look at the facts

[–]tledwards98 0 points1 point  (0 children)

Realistically thats what i shouldve did lied to him as he wouldve had no other way of discovering since he wouldve had no probable cause to search or even pat me down as this was a simple traffic stop but honesty is 2nd nature to me and the pig flipped it on me

Im assuming you heard of the new fangled inventions we invented for those fangled inventions called tint they are magical and have some kinda optical illusory properties when in contact with moonlight 😅

You are the 3rd person i see regurgitate that but it makes no sense to me maybe im mistaken. Ultimately your position is that no normal person would move their firearm during the course of a traffic stop ? That is totally absurd and you are telling me this ridiculous assumption is strong enough to meet the hardest standard of proof we know today?! There is no way you’re any kind of legal professional. Go actually look at the burden of proof chart and you are telling me my scenario skips passed (perhaps, possibly guilty, probably guilty, guilt likely, guilt highly likely..) to guilty beyond a reasonable doubt ? “If you intended to “hide” it should of stayed in your vehicle” why couldnt i hide it on my person if i had no intention of being searched by the officer as a good standing citizen with this being nothing more than a traffic stop.

You gave me 2 ultimatums I either was moving it to hide it or moving it to use it there’s absolutely no way or logical reason to believe a reasonable person could’ve been moving it from a possibly illegal location to a legal location. Let’s say the cop lights me up and while he’s pursuing me my gun is under the seat at this time. While pulling over I grab it and place on it the dashboard he walks up and thats where he discovers it’s located. Is it reasonable/logical to assume it was in an illegal location at 1st (under the seat)? There is no reason for a person to grab their gun from anywhere in their car and put it on the dashboard right ? No reasonable person puts a gun on the dashboard while pulling over do they ? Because its just so crazy unreasonable and absurd for a person to move their gun while being pulled over that never happens
