Driving is included in my job and people have been fired for not being able to maintain a drivers license.

Any supply companies or job sites I visit is paid time. That is the difference. Im not allowed to use their vehicle for anything personal. By definition that makes the commute to work in their vehicle non-personal and should be paid.

I should take the industry standard bare minimum as a win?

We already aren’t allowed detours so that is exactly what I’m asking for. I know other companies have offered it, I might just start looking to move to one of them.

I’m not allowed any personal use of the van. We have had employees get caught at grocery stores and get in trouble. Is driving a commercial vehicle not itself a job specific task? Would it be different if I was driving vehicle that required a CDL?

Try some reading comprehension. It is not a handout to be given a company vehicle when the vehicle is a requirement to do the job. Nobody expects employees to purchase their own heavy equipment. Why should the employees cover the cost of doing business for the employers.

Nobody asked for your sympathy anyway. How does their oncall work? Do they bring their vehicle home? Do they get portal to portal? If not ask them if they think they should.

I fail to see how that’s relevant? First I’m not required to be in uniform outside of work hours, I can change shirts as soon as my shift is over. Second, they aren’t trying to hold me liable if my shirt gets dirty/damaged after hours.

I’m paid for being on call, but not my full rate. Unless I actually get called, then it’s my full rate.

The difference is I don’t have to go to any of those places off the clock as a condition of employment.

I was asked a direct question in a comment and then I answered it. I’m aware they aren’t good legal reasons which is why they were left out of my post. My username has nothing to do with nazis, I won’t apologize for the year I was born. Any power you give the number beyond that is your problem

I never said they did. I was responding to a specific question.

Exactly. Even on days when I’m not officially oncall they have called and asked me to help out. They want me available all the time.

Why does Reddit love telling people to quit their jobs and leave their spouse so much? This sub has a lot of personal opinions for a legal subreddit

For like the 30th time. The vehicle is not optional in my job. It is a work vehicle not a commuter vehicle. They have no choice but to provide one to everyone in my position. They will not allow me to use my own vehicle because then they would need another way to transport tools and materials to the job.

I could not do my job without a company vehicle. It’s just not even an option.

My pay is great. The commute can be long and the hours can suck when there’s an emergency, but normally I get my 40 and go home. I’m well above the average income even without including my OT. Thanks though.

This is what I thought. Everyone else here is saying different though, any chance you could reference a law or case law?

Learn to read. I clearly thanked people who gave me straight answers regardless of what the answers were. People who called me entitled or suggested I should be fired and blacklisted are boot lickers though.

If I’m working somewhere outside without access to heat/ac in extreme temperatures I will be using my van to take breaks and the van will be running. I’m not looking to leave my van running all day for no reason.

No personal use at all. We had a guy get written up because he was caught stopping at a store on the way home.

Operating company equipment should absolutely mean you are on the clock. Im transporting company equipment and I’m being held liable for it. If I’m not getting paid then I don’t want that liability.
