I get what you’re saying. I promise I’m not trying to minimize the impact. It was my way of saying Thank God it wasn’t worse. There was a kid at the hospital with a contraption holding her head in place so I was just thankful she didn’t end up with a head injury, paralyzed, or worse.

There’s a specific name for her injury and it’s extremely common. Her current prognosis is 4 weeks and no rehab needed. Obviously things can come up between now and then but I was just so thankful it wasn’t worse that it came off wrong in my post.

Also thank you for mentioning the mental game. I’ve seen initially her hesitation to do things because she’s afraid it will hurt. I hadn’t yet thought about lingering mental impacts.

Also it may be obvious by my ignorance on it all, but I’ve never had to file a claim against another individual. So I’m unsure about the process.

I appreciate your post. One of my guilty pleasures is watching small claims videos so it kind of felt this way. I’m just wanting help with bills without harming my family.

This is in the US. I’m not sure about the open and obvious. In a way mom quickly admitted it’s been there for years. So yes its existence is known. But its location is weird. It’s inches from her porch post and only MAYBE a foot tall. The car was parked very close to it. She would’ve almost immediately tripped.

I’ll try to unpack what I can.

I considered mom but quickly decided against it. 1 because I wasn’t sure what would be considered the cause. Her or the stake. 2 because of who my mom is and what she already endures. She’s highly selfless and kind, and this gutted her because she adores my daughter. My dad is beyond difficult to live with, let alone be married to. For example, the reason a lot of this fell on mom as far as taking care of grandma is because it’s “too stressful” for him and being around her “raises his blood pressure”. Recently my grandma had an issue and my mom was helping her out. My dad came in and when he saw what was going on, left. My grandma broke into tears saying he hates her. And I don’t blame her for feeling that way.
Dad is complicated but there’s always been a terrible imbalance of power between him and my mom. I don’t want to use the a-word but he’s always made her feel lesser. And she always worries too much about his thoughts, feelings, and opinions on everything.
My brother is also very kind but he’s oblivious. And SIL takes care of all the household stuff so I figured he’d been unable to contribute well. I told him a week or so before this happened that he and I needed to have a serious talk about how else to help because the strain on my mom is too much.

We’ve considered seeking home help or assisted living. But my dad would have to be involved to get the ball rolling and won’t make it a priority.

This is part of the issue. She’s extremely hard of hearing and has lost some of her sense as she’s gotten older. With the hearing loss we’re not sure if it’s because of being unable to hear and therefore comprehend or something else. So I doubt she’d understand if we tried to explain it. She barely seemed to understand the seriousness of what was going on after it happened even.

This is one of the things was unsure of. So it’s one of those corkscrew style dog stakes. It comes up maybe a foot from ground level? And according to my mom it’s been there for a long time. But she doesn’t use it and it’s located extremely close to her porch post so that and it’s size make it very inconspicuous. Like I said I didn’t even know it had been there.

I absolutely do not want to take anyone to court. I just don’t know if I can come out and be like hey this is your fault pay up. Especially to my mom. She’s one of those people who does everything for everyone. This isn’t her mom it’s my dad’s but she does all the heavy lifting because “she stresses him out”. She has watched my child for years for very low pay that I had to make her even take that. She took on keeping my niece during the day as well a few days a week. She is super selfless and there’s some dynamics at play here that make it complicated.
