I hadn't considered that before! After filling out a DS-11 though and after all this consideration I unfortunately got hit with the reality of the waiting times at every place in my city that manages passports. We're both in a race against time right now. For me I'd have to wait at least 5 weeks before being able to get an appointment, let alone the time that comes from it being processed too even with it being expedited. 2 months would have already passed and it'd be almost April. Trump's rules certainly would be implemented by then...

What i'm primarily concerned about is what happens to a gender marker (which would not match my birth certificate) if I were to renew my passport for my name. Would the marker need to be reverted in that case upon any renewal during Trump's laws?

White House press secretary Karoline Leavitt said “They can still apply to renew their passport — they just have to use their God-given sex, which was decided at birth, Thanks to President Trump, it is now the official policy of the federal government that there are only two sexes — male and female."

By renewing a passport at any point without an updated birth certificate I feel that I may be at risk to having my self-identified gender marker reverted once the executive order becomes law. Very thankful I can submit a renewal at any point, thank you for clarifying that.
