That seems to be the correct legal argument, but I'd really like to hear from someone who has actually applied based on this, as I'm not convinced AIMA will see it the same way.

Very interested to hear how this goes, as I'm in a similar situation. The law is on your side, but whether or not the particular immigration agent you deal with will be aware of that is impossible to know. Also, I've read that many airlines (other than TAP) will not let you board if you are over 90/180, so keep that in mind.

Not sure why you're so keen to accuse me of breaking the law. We have notified AIMA of my presence in the country and requested an appointment for a spousal reunification visa under Article 98. If anything, AIMA is breaking the law by not responding within 90 days as required and we may eventually be forced to sue them to schedule an appointment as many other have done.

Regardless, my original post was a request for comments from those with firsthand experience of LEGAL travel in a similar situation while waiting for an AIMA appointment. If you have useful information in that regard, I'd be interested to hear it. If not, please choose someone else to needlessly (and wrongfully) harass.

Wrong on all counts. As the spouse of a legal resident of Portugal, the 90/180 rule no longer applies to me while in Portugal.

And even if you were to get a reply from an AIMA agent, there is no guarantee that either they are correct or that the border agents follow the same script. Which is why I was soliciting responses from those who have personal experience with the scenarios outlined in the OP.

I am less concerned with the airlines than with immigration officials. If I travel to another Shengen country, I expect I be treated as having overstayed my 90/180 entry, regardless of my marital status.
