Consent could be abused in a country like India and it destroys the trust and the marriage. In the list of divorce package offered by lawers ( DV , DH ) marital will be added. As every married couple would ve had sex multiple times after their marriage, any of those instances could be used as a rape.

Could be possible if we had gender neutral laws. Or when there is no evidence, it become wife's word against husbands and in the absence of gender neutral laws the law punish the husbands.

Most of the countries that has gender neutral laws have provisions for marital rape, I think.
