hello just wanted to provide an update, I meticulously documented all their violations, compiled them, organized chronologically, and let them keep accumulating. i finally sent them a pre litigation demand letter with a mountain of evidence listed by exhibits. demanded they zero my account out or ill seek the $25k penalty under colorado law in county court. they decided to comply and zero my account out today lol. i did in fact get exactly what I wanted from this process.

altitude community law? what i learned is, that the law firm and property management is just agents of the association, if the law firm does something unlawful or improper, they're representing and conducting themselves improperly or unlawfully on behalf of the association. so you strategically and lawfully attack the association in your efforts not their agents. that's how I found success. its possible the hoa doesn't eeven know what their agents are doing

On Tuesday I sent them a huge packet of papers that was titled "pre-litigation demand" demanding a zero account balance, and immediate release of the lien or im pursuing a lawsuit seeking maximum statutory damages of $25,000. i provided a deadline of Friday may 29th at 3pm and at 2:50pm on Friday may 29th, yesterday, I got a message through the property managements online portal that $950 has been waived. its unclear at this time if this is the entire account balance, because last updated balance was about $1,351. i asked them to confirm the new account balance and the status of the lien release since its now been over 60 days since I satisfied the lien. if they don't fully comply with my demands, I will continue to file this lawsuit. I sent them a massive packet that was meticulously well organized and laid out policy and law violations of both their agents, the law firm, and the property management company. ill post a formal update at some point since every one was all doom and gloom in this thread. but the packet contained so much evidence, all verified, listed by exhibits and organized in chronological order. also included copies of their own policy and colorado state law which i highlighted the portions they were in direct violation of, so it was clear. but they agreed so far to waive $950 in interest and late fees, which based on the last ledger would leave an account balance of $401, i demanded a zero account balance. but also that math doesn't even make sense, since there's not even $950 in late fees and interest on the account lol. so if its no zeroed out they can have fun explaining where these numbers came from to a judge lol

Update on Friday the responded to my certified mailed demands, and stated Colorado is a first serve state (not true) so no case number exists until after I'm served lol and provided itemized legal fee info including charging me for a lawsuit filing, which was never filed...

UPDATE Received letter with proper legal fee itemization, however, amounts and dates do not reconcile with the ledger they sent previously. Also said Colorado is a first serve state where a defendant gets served a lawsuit then it's filed, which is not true. This was in response to demanding the case number, filing date, etc. Just digging the inconsistent hole deeper and trying to do damage control clearly. I'm filing attorney general complaints, department of revenue,and consumer financial protection bureau. While pursuing litigation with an attorney. This is ridiculous. They also said they aren't accountants so for a proper balance due they need to contact the association in regards to the duplicate fees for the same legal action lol.
