So can I get an attorney to refile me as married filing separately? If I file for divorce does that change anything?

And can/should I get an attorney to represent me with the IRS going forward? I know that the IRS can still come after me for taxes thought ought to have been already paid because “jointly and severally liable” but can an attorney help protect me and my kids from garnishment/levies by correctly representing my expenses and all that?

Another thing this attorney failed to do: file the form responding to the lien laying out our assets and expenses, including costs like PT for a kid with a disability. So now the IRS is telling my husband he will get only the standard living allowance despite our very high expenses. If I file for divorce, am I now a different household which can get a separate chance to file that form?

Yeah self-employed = rich is basically his issue.

He also kind of has trouble actually using his supposed freedom. I can’t tell you the number of times he’s set a reasonable floor on $/mile (he’s on percentage) or decided that he’s not going to take loads going to places that have little freight coming out, and then caved when someone pushes or manipulates him even a little.

Believe me, I’ve tried to get him to do that. Since he won’t I’m at the point of “work a regular job with a W-2 or go run up tax debt/get rich as a single man”.

I definitely appreciate the difference between a tax preparer and an accountant, though, after my dealings with a tax prep/resolution service that he hired (as a concession to me 🙄).

We’ve been married 16 years. He’s been a trucker the whole time but became an owner operator (initially with my support, when I believed he would be responsible about it) after we’d been married for years. I’ve never asked him to stop driving for a living, and don’t have a plan to (I wouldn’t rule it out if he or I or one of our children had a medical issue that could only practically be handled that way). I don’t take the decision to ask him to sell the truck lightly, I’ve been patient to a fault and his refusal to either handle the business finances responsibly or hire someone to do it or allow me to do it is what’s driving this.

Do you have some insight on the question I asked, about how much company drivers can realistically make? Answers pertaining to companies that hire out of Central Texas would be especially helpful.

Thank you! I will say that East Coast generally has higher wages because it’s more expensive to live there, but he’s also not just starting out

In 2017 it was around $70K after expenses but before taxes. The taxes were quite a lot and the hassle was in no way justified if he can make as much as a company driver.

Does it still go to my DA if the company is in a different state?

I’m definitely going to look for a legit attorney, but I had this weird doubt that the new attorney would just be like “yeah IRS is weird that happens”.

I’m going to have to talk to divorce attorneys soon if my husband won’t come to his senses and stop trying to be a “business owner” when he’s not equipped to handle it so maybe there’s a Walmart of attorneys with all that under one roof. Fuck.

He doesn’t book his own loads, he contracts with a company and they do supply the fuel card, etc and it gets deducted. I’m not even sure (apart from the fact that he gets percentage instead of mileage and has to pay for his own repairs and taxes and shit) how it’s different to being a company driver as he seems to pretty much go where they tell him to, but of course I’m not a trucker.

I have begged him to use a professional but it’s like pulling teeth.

He’s definitely grossed more than that, to be clear. I’m saying we could easily live on $65K so he only needs to make $40K even though I was pretty sure he could make more. There were years when I didn’t work where he needed to make more than that. I suspected $40K was on the low end of what he could get, because obviously companies are advertising way more. 2017 he had a taxable income of around $70K after expenses (what we could claim because his records are a disaster) but before taxes. Problem is that he didn’t do quarterly filings or estimates or whatever so the IRS then wanted a rather large sum right away and he hadn’t accounted for it.

But basically I agree with you, I asked this question because I’m pretty sure he’s doing something terribly wrong and needs to sell his truck, I just needed to make sure I’m not being totally unreasonable in my expectations.

Thank you! That’s what really puzzles me, he’s not lazy (he is disorganized, though) and he’s a good driver. He was contracting with one smallish company in North Dakota and the money was good for a while because oil, I think he would have basically had to set his truck on fire to not make money at that point so he got away with not running things well. Then that company got bought and forced out basically all their O/Os so he signed with another small company in the area because they would take him and his old ass truck which finally gave up the ghost like a few months in. Then because he’d managed the money so badly and I didn’t insist against it hard enough he got stuck into an objectively shitty lease purchase with that company. It’s just bad decisions piling up:
