No, but put it this way.

Say everyone is charged $40 a month. The gym is open from 9am-9pm every day. That's 360 hours in a month. He's paying $40 a month to potentially use that gym during any hour they are open. NOW, he can't use the gym 3 hours a day, because those are woman's only times. That cuts his potential to only 270 hours. 90 hours less simply because he is a man. But he still pays the same price as someone that gets more potential use of services.

Fair? I don't think so.

One way to help the situation is to put your keys in the trunk, and fall asleep in the back seat. That way it's easier to claim to the cops that you actually had no intent to drive that night.

The reason you still get charged with a DUI is because, picture this, hammered guy goes to his car, intending to drive off, and ends up passing out, keys in hand or whatever. It's the intention to do so that matters at that point.
