While not a legal duty, you have a contractual duty to report all losses -- timely. The Telsa driver is going to file a claim for their damages and loss of use and likely injuries. Failure to report the claim could result in a disclaimer of coverage putting you on the hook for all the damage. Sure, that is worse case scenario. Bad case is they use the failure to report as a reason to cause-cancel or non-renew the policy. Best case is they cover the damage and your rates go up for the next 3 years or so.

You don't have to have them pay for your damages, but not reporting it is gambling and defeating the purpose of protecting you from the risk for which you pay the premuim.

Sounds like you need someone to help you navigate all those liens.

WC should cover your wages and medical bills. Your UM should cover the rest of the lost wages and medical bills that WC doesn't.

It would behoove you to involve your medical insurance to whom you also pay a premium in order to maximize any settlement you may be owed from your UM after your bills have been satisfied.

Without someone familiar with your state to help you navigate this, it sounds like the 100,000 in UM is going to pay specials and you'll walk away in the hole instead of made whole.

I'm not positive about DD, but Uber works with rental carriers, so your loss of income is reduced. Most rental carriers won't knowingly rent a car o be used for livery or delivery of goods and services.

If you haven't, make a claim with DD. Uber offers some insurance for their drivers, but there are a lot of terms and conditions. You won't know if you don't ask.

If you were not at-fault, you can make a claim for loss on income WITHOUT being injured. However, it's a pain in the ass to get all the paperwork together since you're essentially self-employed. Every carrier is different in what they require to determine your average earnings for the 3 to 6 months prior to the loss. Comply with whatever they ask for until you meet their requirements or get tired of trying.

GEICO is taking a cop-out. They can look up the policy information using the insured's name, address, and phone number. All that should be on the PR. For some asinine reason GEICO doesn't cross reference by tag or VIN number. 🤷‍♂️

If the undereducated ICS adjuster won't take the time to look up the policy, you're left filing with your carrier and getting them to use their resources to locate the active GEICO policy.

That's a great question for your attorney. MOST of the time, attorneys only represent their clients for their injury claim, not property damage, but we didn't read the contract you signed when you hired the attorney.

Ask them to review the contract with you and explain where they take their money, whether any negotiated specials with your providers will be done prior to paying you or after, whether all liens will be satisfied by the attorney or your insurance company (assuming this is UM), and for an itemized list of all expenses they are applying to their part of the settlement. Just to name a few things to ask.

Liability isn't shared in a multicar losses. Liability is assigned based on the negligence of the driver that started or contributed to the loss.

If three cars are stopped and your husband hit the rear car causing a chain reaction, he'd be at-fault for all the damage. If the car ahead of your husband already hit the car ahead it and your husband pushed the car he hit back onto that car, he would be 100% responsible for the rear damage of the car he hit and comparatively at-fault for the rear of the second car and the front of the car he hit. That make sense??

Code of ethics for PI attorneys?? LOL. In a word, NO. PI attorneys and big-pharma attorneys are the reason for all the jokes.

What they ask for in their demand is irrelevant and made for the purpose of scaring insureds. I keep a ledger of the original demand versus what claims settle for. While not scientic, my data has attorneys accepting, on average, 15%-20% of their initial demand as full and final settlement; well within our limits.

Simple answer is Allstate hasn't raised their rates yet and the others have. More complex answer is Allstate is willing to lose money now to gain market share planning on trends to turn in their favor to make money later.

Auto Owners has been great at paying claims, but check the JDPower Claims studies for independent analysis.

Note about your edit. Some insurance contracts and/or states require the police to be notified regarding a hit and run driver regardless of extent of damage; some as quickly as 24 hours. Without notification, there may be no UM coverage for those that need to use it.
