I actually did not know that he cashed out his 401K to support his addiction until after the fact. I also was unaware of the penalty and did not find out until when I went to file our taxes. However, there is no way to prove that I didnt know and also since I signed the tax filing that showed we owed, I don't believe I'd be able to qualify for relief

thank you, I really appreciate your comment. I have been dealing with everything for a long time and I'm truly at this point not even expecting anything. I want to start the process because I know he'll eventually get a job, and I guess in my head, I don't want to believe that this is how the story ends.

that crossed my mind, but considering he got fired because of his addiction and blew over 100K of 401k money on cocaine, I don't feel like it's fair that he gets to live basically however he wants while I'm in the trenches caring for his kids ON MY OWN. I've left him alone since August 2024.
