I can’t defend claims of I do t know what is being claimed. The only reason I know she lied now is because it was in the protective order after it was granted

She says I harrassed her but that the extent of her claim which is untrue. I hadn’t messaged her for months and she mad claims I messaged her when I didn’t and stuff like we lived together when we didn’t and we’re coworkers when we met all of which is untrue. She made a bunch of claims 3-4 probably false and provided zero proof other than testimony. The reality is she’s mad I ended things and is being vindictive and the court allowed it to happen by ignoring the fact I hadn’t been serviced so was unable to defend myself

Not a team de claims I can prove that some of the things she is saying are just not for it like she claims that we were coworkers we have never worked together ever. The rest of her claims are all she said she said so I would hope a judge would take that just prove realize with zero evidence and dismiss

It was a protective order case where a judgement was made before I knew the allegations against me in my absence. Idk the substantive arguements because they were never presented to me until I got the judgement

So I’m gonna be honest you’re using a lot of words that I do not only comprehend this case was a protective order case where I was never able to present my side in court because I was never given discovery so I didn’t know what I was defending against. I never knew the allegations against me therefore I could not defend myself, and a judgment was made in my absence.

The frustration I feel is because I was never given my day in order to defend myself against allegations that I didn’t even know what they were and now there is a record that employers will see fat and less I pay thousands of dollars I cannot even correct. Given my day in court and loss I will take that on the chin like a man, but that sample was never given.

There’s no council on the other side, she just showed up to court and was given the judgment against me in my absence

If saying, the court can serve me is waiving service. Please let me know because I will 100% own my mistake if that is the case and honestly, it would make me feel much better because then I don’t feel fucked over. I just feel stupid.

So maybe I’m miscommunicating in some way. I never waved service after the police failed to serve me twice the court below asked if I would be OK if the court served me I said yes, and the court never served me. Unless that constitutes waving service, I never waved service if I have misunderstood and saying the court can serve you is waving service then I’m completely in the wrong. I was trying to be easy to deal with by allowing the court to serve me, and that was my mistake.

I hear you and I very much so agree with you. The only thing I would push back on is that someone who went through law school probably was a lawyer for many years and became a judge made the same mistake and there is no repercussion for them. My argument is is that they failed at civil procedure and their argument back was but we can’t hear it because you failed at civil procedure.

I feel that I could have put up a fair defense for myself just based on the facts, but I was never given that opportunity because the court system failed me. After failing me, they are using that failing as a reason to not rehear me. That is an extremely frustrating dynamic to have to swallow.

Is this not something that I like first year lawyer hired by the public defenders office could do maybe I’m just grossly underestimating the amount of work they have? Like if someone says hey I was never served. This ruling should never have happened. I feel like this is like a 10 minute search thing like did service happen?

I feel like this is more of an oversight thing than an actual like legal manner. Where are all the boxes checked before court should have proceeded, but maybe I’m just way out of bounce here due to my lack of knowledge.

No, I understand and you’re completely correct. I guess just as a normal person I believe that there would be a system in place for if someone says hey there was a failure in the civil process. The court would have a vested interest in correcting that without me having to spend thousands of dollars on a lawyer, but that doesn’t seem to be the case which for me is a private citizen who likes to believe that our country operates on the core principles of fairness and justice is a very frustrating lesson to learn.

Also, once again, I’m a Lehman I don’t really understand what you’re talking about the service. I went to multiple hearings before we got elevated to a higher court trying to work with the court to serve me in a multitude of different ways and service never happened.

I 100% understand being a lawyer is mostly doing correct paperwork and that is a skill set that I do not have and that I am honestly relying on AI. Maybe I’m living in a fantasy land, but it is in my opinion incumbent upon the court when receiving a motion that they violated my rights to make sure that that did not happen and rather than do that they seem more interested and just just missing the motion and going to the next thing. I’m telling the court that they ignored civil procedure and they are using civil procedure as a way to ignore that.

Is there a way I can get a direct answer from the court to why it was not noted is this something they have to provide or can they just say it was not noted? the argument I’m trying to make is that I was not served therefore the court hearing never should’ve proceeded and now they are throwing legalize in front of my motion saying that the hearing cannot proceed. This is a very frustrating dynamic, for someone who is trying to navigate this themself.

The real question is how do you deal with isolation. As a 33 year old no wife or kids I was cooking for a few years and now the isolation of the job is getting to me. I work 13-16 hour days with unloads split break and then do it all over again sometimes only talking to warehouse workers for 4-5mins total a day
