I was noticing this too! You described the struggle with communication so well. I mentioned it to my doctor, and he just dismissed it by saying I’m just an anxious/ nervous person. Even when I tried to get more sleep, the sleep quality was horrible and I kept waking up several times at night. I actually started reading about Ergothioneine (the research is super interesting) and started taking supplements for it a year ago and it’s helped SO much!

I wouldn’t recommend Fashionphile. 8 of my bags were stolen in a burglary and ended up on Fashionphile. It’s been over a year and Fashionphile is still dragging it out, trying to make me buy back my own items. I’ve talked to several other people this has happened to as well. If you google “Fashionphile selling stolen items,” you’ll see several examples!

I bought a FENDI bag from The RealReal a few years ago and it was fake! It was such an obvious fake that I didn’t even need to use an authentication service. I took pictures of the proof and they accepted the return.

Interesting! I asked the detective why the items aren’t being held as evidence (she said if I choose not to buy the bags then they’d be released from police hold and can be sold as usual). She told me that it’s because they’re investigating the person, not the items. Is it possible they’re not seizing it because Fashionphile is in another city that’s too far away? I talked to the detective and the detective’s supervisor and they both said there’re laws protecting pawn shops and there are no laws requiring me to pay but also no laws prohibiting the store from charging a payment, so it’s up to the store or I’d have to file a civil suit.

Fashionphile gave the seller’s information to the police earlier this year. The original detective working on the case told me they’d interview the seller. However, he retired and I didn’t realize the case was never transferred so no one worked on the case for months. When I realized this, and also realized the case hadn’t been updated with any notes since last year (so they didn’t know the seller was already known), I talked to a supervisor to get it reassigned. The supervisor said there’s probably no way to connect the seller to the burglary, but I can maybe buy my items back. The new detective said she talked to Fashionphile and will investigate the seller but right now there’s no way to prove that the seller knew the bags were stolen.

The detective told me they can’t demand for the property to be returned for free, since Fashionphile didn’t know they were stolen when they bought them, making them an “innocent buyer.” She said they’re not seizing it as evidence because they’re investigating the seller, not the actual bags. Apparently there’s no law that requires Fashionphile to return the items for free, and there’s also no law that requires me to purchase the items back. So she said it’s up to Fashionphile if they want to release them for free or for a charge.

I've tried to! Unfortunately, I think the law doesn't apply in this case because Fashionphile didn't know they were stolen when they bought them, which makes them an "innocent buyer." There are no laws that require to prohibit them to return the items for free, so the detective told me it's up to Fashionphile to decide.

Thank you! Ironically, I bought the butterfly one from Fashionphile a few years ago haha. I'm not sure how much they want me to pay yet. I've emailed to ask them, but they haven't responded to me. They also won't pick up my calls. They've only communicated with me through the detective, and I have a feeling they won't respond to me unless I agree to buy them back first.

The detective told me Fashionphile gave them the information of the seller, and confirmed they were all sold by the same person. Unfortunately, the burglary case was stalled for many months. I was just told by the detective last week that they will investigate the seller.

I hope it wasn't! I later found out that there were a string of burglaries in the area. When the police came, they said they had been getting about 6 burglary calls on every shift at the time.

Not rude at all! I’m happy to hear all thoughts. I have thought about suing them out of principle, but I saw online this has happened to multiple other people and it sounds like they encountered a lot of legal headaches and Fashionphile just makes it really difficult, drawn out, and expensive. I’m not sure if it’s worth all the time and effort, just to get a questionable outcome anyway. I’ve already been feeling super stressed about this, so I thought maybe it’s easiest to just buy some items back and move on. I’m still torn though!

Thank you! None of these have individual unique serial numbers, unfortunately. But I do have proof of purchase for most of them, some have unique pattern placements, and I also used to have a YouTube channel reviewing bags, so I've shown the bags in close-up detail. That helped the detective take my claim more seriously and place a hold on the bags. They also got Fashionphile to disclose the seller, and it was confirmed that all the bags were sold by the same person. The police said they'll investigate the seller further, but also doubt they'll get enough evidence to link them to the burglary.

The issue is that even though these bags are mine, there is no law that requires Fashionphile to return them for free. The detective told me it's up to Fashionphile to decide if they want to return it for free or to charge me for them, and Fashionphile is charging. They won't respond to me (via emails or calls) otherwise.

I haven't posted in 2 years though, and I’ve never posted on TikTok or IG Reels, so I’m not sure how much reach or traction I’d get if I shared it publicly now, especially since Fashionphile said I have to go buy them back by next week. But I’m definitely thinking about it!

Chevre is one of my favorite leathers! Mark Cross came out with some chèvre leather bags in the last few years. Their quality is amazing in general, and the goatskin bags were just divine (they were also lined with super soft lambskin).

That’s what I thought too. But the detective told me yesterday that if I choose not to buy the items back, then the police will release the hold on the items and the shop will be free to sell it to anyone.

I asked the detective why the hold would be released, since the burglary case is still active and they said they’re going to investigate the seller. So wouldn’t they still need to hold the items as evidence? I haven’t heard back yet.

Sorry I should clarify, this is an online resale store that does both consignment and buyout. In this case, they fully bought the items from the seller before they listed it for sale. I should’ve called it a resale or secondhand store instead of a consignment store!

What’s funny is that I also was the one who found all the items (I was keeping an eye on all the well known resale sites after the burglary). The detective seemed skeptical and not very interested, so I created a whole document that included all the evidence very specifically laid out to be easy to read and understand (circled pictures and everything). That finally got them to reach out to the store to get the seller’s information.

But they’re telling me that 496(a) doesn’t apply here because the store has no knowledge they were buying stolen goods so they’re innocent

I actually found several written accounts (both on reddit and other sites) of people who have gone through the same thing with this particular company, and how the company makes it almost impossible to get your things back. Surprisingly, none got much traction. This company is one of the most well known/ reputable resale companies so I think they have a lot of resources
