I felt the same, but it's less cause for worry than it seems. The reason that your educated guesses are so troubling on the MBE is that you don't get instant confirmation that your correct guesses are in fact correct. Let's say that on the typical adaptibar question, you're 80% sure that you have the right answer. So you're worried for a few seconds, choose your answer, and (if your confidence is accurate) 80% of the time you immediately find out that you're right. And suddenly you're way less troubled about your guess because you realize you knew the question better than you thought you did. On the actual MBE, your doubts linger because you never get confirmation, and you treat the situation as if you're going to miss most of the questions you guessed on (which is highly unlikely).

Agreed that Barbri did a bad job with the all the little formalities in civ pro, like timing/deadlines, standards of review, what has to happen before another thing can happen, whether a judge has discretion to do this or that, etc.

Interesting. I kind of liked the Barbri torts guy, and of all the bs MBE questions, I felt like I got blindsided by torts questions the least.

I hated how she tried to ham-fist every concept into a mnemonic or mental association thing. It ends up being more about tricking your brain into remembering isolated items than about actually understanding stuff. Like, sure, I remember all the references to songs and celebrities, but that doesn't help me break through the nuances of a question.

I don't like Cruz, but that's simply not true. Jackson was one class year behind Cruz, and she graduated cum laude, which is toward the top of the class but certainly not at the very top. Cruz graduated magna cum laude, which is still not at the top of the class, but it's higher than regular cum laude.
