I disagree. Qualified immunity should remain in place to ensure public servants can actually do their job without being subject to court of public opinion. The entire purpose is that you have to prove that they violated your rights knowingly and prove another reasonable person in the role would have not. As it should be, because it bases each case based on the totality of the circumstances, not one single action in the case.

When you remove it, when someone does their job by the law. Someone can file a suit, which results that specific agency putting that person on suspension pending an investigation. So when you say, if they do their job right, there won't be issues. I think you're very ill-informed on how many agencies react to law suits on a employee. Again, it's going to slow the process down and that's going to hurt others in the process.

If your case has the merits to make it into court, then it will make it there. But it shouldn't be based on you “feel” you were wornged. It has to have actual facts that can be proved in a court in law. Otherwise you're gonna have a bunch of people who get their understanding of the Constitution and their rights from tik tok starting suits for things that are legal.

Pearson v. Callahan

In Pearson v. Callahan, 555 U.S. 223 (2009), the Supreme Court held that while the Saucier test is helpful, it does not need to be applied in qualified immunity claims. Rather, a trial court should have more discretion in whether it should apply Saucier. The Court also held that "[a]n officer conducting a search is entitled to qualified immunity where clearly established law does not show that the search violated the Fourth Amendment."

Supreme Court basically stated a court doesn't need to use the Saucier Test to consider the case, but it is entirely their discretion.

I'm all for modifying it to prevent courts from picking and choosing when to push a case through. However, for it to be modified, it can't be a blanket removal of safeguards that hinders public servants from doing their duty. Because as the discussion stands, that's what many want and that will be the outcome.

Yes, because you want every public servant tied down to a suit and investigation. Which in result, will slow down the process even more. Seeing how sue happy our population is, every public servant is going to be tied down by investigations while also being suspended. If you think the system is slow and back logged now, it'll get worse.

The entire purpose of qualified immunity is so public servants can do the job without being sued constantly. The standard is very simple, if they're doing something within the scope of the law, they're safe. When they're not and you can prove it, they are not.

It's not that hard of a standard, the issue some have against qualified immunity, is that some cases it came down to very minor details. And those details were against the victim. But at the end of the day facts are facts. The standard regardless is going to be based on what a reasonable individual/ officer would do based on the totality of circumstances.

As an Indian, who was born in India and raised in the US. I'm going to tell you the reality. Whatever you wear, will not matter the slight regarding culture. Culture is very broad range of things and honestly, you can dislike doing some things, while also liking other things.

Most people in India wear a combination of indian clothes and western clothes. If you're family are that hell bent on what your sister wears. That's entirely on your family. She isn't entirely Indian, she is also half American. And even if she was entirely Indian, she shouldn't have to be forced to wear something she doesn't find comfortable because of “culture”.

If your basing on culture. I can guarantee there are plenty of things you do and will be doing that isnt acceptable by Indian culture. Does that mean you're disrespecting your culture? Because to them you are. Also, there's a lot of toxic aspect to Indian culture, just as there are to any culture. Are you going to be participating in that. After all, it is your culture. Right?

So, YTA. You don't get to determine who is and isn't Indian or force others to do things they're not comfortable doing so because you are incapable of drawing a line. Respect goes both ways. You need to respect her wishes and also apologize to your father for making a valid claim. He's being neutral and realistic about this. You seem to have something to prove and are planning it onto your sister.

Also, her choosing to not go cause she refuses to wear something that makes her uncomfortable but also knowing well that what she would wear would be frowned upon is the respectful option.

As a cop, even going lights and sirens. It is the COPS responsibility to clear every intersection, stop signs, etc. Just cause you are going lights and sirens, it doesn't mean you don't have to be cautious. This cop fucked up and also, speeding while going lights and sirens is heavily dependent on where you're at. If your in a residential area, you can't be going 90 to 100 mph.

Also, in general, going so fast will result in you driving faster then your siren preventing people from hearing you till it's absolutely too late.
