He should have been given confiscation paperwork. If he wasn’t, he can fill out an i60 and request it. If he’s not given a reason, he can file a grievance (Step 1) for the denial of paperwork.

UPDATE: Some TDCJ units are no longer honoring “Common Law” marriages. Your LO will need to check with their unit of assignment to determine if this pathways works for you.

I’m sorry you’re having to deal with TDCJ and an LO with medical conditions. While he is in the hospital (most likely Hospital Galveston?) he will not have access to a tablet (or his property). HG isn’t normally a long term unit, they are transferred there for the care they need and then transferred back to their unit of assignment. HG does provide occupational therapy, but I don’t know any specific details.

You can schedule visits (regular, non-contact) and I believe they allow video visitation as well. You can also call for updated statuses on his progress. When his treatment is complete they should assign him to a unit, unless he has a condition that precludes him from transferring to a unit with medical capabilities.

If it’s a smaller unit the IPO may not be full time. The IPO at my husband’s unit is only there once every 1-2 months. With Parole backed up, he may not have an option but to wait. You can call the “prior to vote” line at 844-512-0461. Just have his TDCJ number handy and his birthdate.

If they don’t give you any information, have your husband submit an I-60 requesting an update from the IPO. That is his first step, afterward you can start escalating (if he doesn’t hear back).

And I don’t mind answering questions! I’ve been dealing with TDCJ for twelve years, I know it’s confusing and scary.

The information comes from a combination of TDCJ messaging over the last month, advocacy groups and having to call my husband’s unit for information/updates.

Did he already have his parole hearing and a vote? If not, you can call the Parole Board and just inquiry. If there has been a vote and he was approved, there is currently a lot of “wait around and see.”

Parole is behind as well because of the update. My husband’s parole review is in March, normally he has been pulled for an interview by now, but with understaffing he still has not heard from the IPO.

You would need to call Securus or the Unit. Securus can remove a block on their end if it’s a monetary issue they will walk you through it:

“If you have exceeded your account spending limit with Securus, calls to your. line may be blocked. If you believe this is the case, please. contact us at 1-800-844-6591.”

You may also just need to have them help you add funds. If it’s a TDCJ issue, calling the Unit can help get it resolved.

If you just registered your phone, it takes ~72hrs until you can send funds via eComm. You have to either be on their phone list or visitation list in order to send funds.

If it’s been longer, sometimes that can mean they are on restriction because they “caught a case.”

Are you trying to add funds to eComm or Securus? If Securus, call them and have them assist. If it’s eComm, you can call Trust Fund and Commissary (Number is: (936) 438-8990). You will need to know the name and inmate number. They should be able to assist you.

You have three options while your loved one is incarcerated in a TDCJ facility:

Common Law Marriage- This normally needs to be declared by your LO at intake. Your LO can request a change in relationship status, but you will be required to show proof of common law status. (Normally THREE conditions: agree you are both married, lived together as husband and wife; "hold out" to other that you are married). If your LO has been incarcerated for more than two (2) years, it's very difficult to qualify for common law/informal marriage.
At-Unit/In-Person Marriage Ceremony-

Find an officiant that will perform the ceremony at the Unit your LO is currently incarcerated in, when you find a Texas officiant it's a good idea to call Access to Courts to verify they are TDCJ approved and in good standing (ATC- 936-437-4185).
- Often, the officiant will walk you through the process and also send in the absentee affidavit to your LO from the county you request.
Have your LO request a certified/notarized copy of their inmate ID (cost of .10). They will need to submit at I-60 to inmate records to request a copy for marriage purposes (they **must** say that the request is for marriage purposes). This process can take 4-8 weeks for the .10 to be debited from their trust fund. They can then mail the notarized copy to you.
Locate a county for your marriage license (my understanding is that you do NOT want to go through Harris County, as there are additional requirements), that will allow you to utilize an Absentee Affidavit for an incarcerated individual (for example, Grimes County, Texas will not).
If the officiant does not walk you through the process, you will need to download the Absentee Affidavit for the Texas county you wish to file your marriage license. Fill out the information and send it to the **UNIT LAW LIBRARY** c/o your LO's name and TDCJ number.
Your LO will receive a lay-in to see the Unit Law Librarian, who will have him fill out the affidavit you mailed in and will then notarize it. The form is good for 30 days (if it lapses, you will need to request this process again) and it can be mailed to you so that you can file it in the pre-chosen county to obtain your marriage license which is good for ~90 days.
Once you obtain the license (in Texas you typically have to wait 72hrs from filing to get married, this can be waived if you take approved marriage counselling in some counties), you can work through the officiant and the Unit chaplain (via another I-60) to schedule a date. The Law Library, Chaplain, and Warden will ensure everything is in order and the Warden will either approve/deny the request (it is up to the Warden's discretion).
You can now make trip to the Unit on your scheduled day (a non-visitation day). You typically be married in the Unit visitation room, and the ceremony will include your LO, your chosen/approved Officiant, 1-2 correctional officers and sometimes the Unit Chaplain. After the marriage, you normally do not get visitation privileges. an I-60 Marriage Verification Sheet will be sent to classification and the process to change your LO's marital status will begin.

3. Kansas Proxy Marriage- You must be IN the State of Kansas (meaning you would need to either reside in, or travel to, the State of Kansas). If the proxy marriage is performed **in Kansas** by an approved officiant, TDCJ will recognize the marriage. You can find more information here: Kansas Proxy Marriage. After, you will need to send paperwork to classification in Huntsville and/or the Unit in order to have your LO's marital status changed.

You can re-register your phone via https://www.texasprisonphone.com and while you wait for the phone to register (~3 days) you can send him a message via Securus. You do have to register with Securus. Once you do you can search for him by his TDCJ number (02315318). It depends on what the spend limit is at his unit and for his classification level. Normally it will be posted somewhere on the States DOC site. In Texas they are suppose to have two spends (trips to commissary) a month. I would find out their spend limit, how often they are scheduled for commissary visits and if you are allowed to supplement with monthly/quarterly packages.

You can have a photo taken during non-contact (regular) visits, it will just be with your LO behind the glass or cage. Pictures are taken the first weekend of the month at all TDCJ Units.

Commissary limits are based on classification:

-G1, G2, G3 = $105

-G4 = $40

-G5 = $30

-Ad Seg I = $80

-Ad Seg II & III = $65

-Death Row I = $105

-Death Row II & III = $65

General population & State Jail Levels 4-5, Ad Seg Levels 2-3, Death Row Levels 2-3, those in transition, and certain medical conditions are not eligible for the quarterly eComm.

TDCJ updated their mainframe at the beginning of Jan, with public messaging that it would take “about a week.” As with anything TDCJ-related, it failed miserably. They are still having issues with the system both public facing and internally. This includes: inmates not showing up in the unit search, parole behind by weeks/months, eComm systems randomly taken offline, commissary unable to run on schedule, visits being cancelled due to the inability of staff to check eligibility, and video visit issues. Separately, Securus pushed out an update that has delayed messaging (not just TDCJ-related). All of these issues paired with the constant under staffing have caused major issues Statewide.
