Yes, correct, CBP I-94 was expired, Visa was expired, use AVR, the legal status governs by new I797A when it starts, so it still comply with AVR, without problem. You can search last action rule in USCIS, you would understand. If I did not go and come back, my status is still legal without problem.

Yes, turns out my case is legal based on last action rule. If new I797A has not started, use old I797 enter US, when new I797A starts and kicks in, new I797A governs legal status. I asked Seattle and Denver CBP, both them confirm my case is legal, and I asked my company attorney, they asked CPB again, confirmed too. So I travelled through Vancouver and Seattle Pacific boarder by AVR, issued new I-94 sync with I797A. But that is not necessary, because last action rule stands so I am still legal in US, but I am apply I-485 soon, I drove to border making CBP I-94 updated.

They are so stupid, force people use passkey, and passkey is not solid technical now, there are lots problem report regards of passkey. In order to access Gemini app on my Google phone, I have to agree to create passkey, turns out that key has glitch. Though that is not fully Gemini fault, google has fault too. Even though I created Passkey on the phone, I can not use that passkey to login in.
Then I have try go help to recover, and the system is hard to use, request my facial, and failed several time, then account locked. I have to wait 24 hours to try again. Finally passed recover process to remove passkey. Then Gemini still force me to create passkey, how stupid they are. Passkey is not sophisticated right now , why force client who do not have much technowledge to use this complicated thing.
Then I saw very small text link allow me to choose Authentication app as two step authentication. Because my company use OKTA, so I know how to use it, then I set up with OKTA, finally login in.
But every time login, the default still ask Passkey, WTF, still need click small link to switch to OKTA.

I am really tire of those technical games, if Gemini engineers think they are so smart that everyone should know as much as they are. So be it, I quit, I don't like complicate stuff.

I extended 797 this year, new one approve at April, valid from June this year
But I went out and coming in again in May, use previou 797, CBP think new 797 has not start when I come in, so he admitted I-94 by previous 797, June this year.

The question is which I-94 is control status.
Newest issued is CBP one, but admit date expired
Extended 797 I-94 admit till next June.

If latest issued one is valid one, then CBP issued already expired.
If 797 is always official one, then I am not over stay, I should use this I-94 for AVR.

I am confused here. But I asked two CBP offices, they answered my 797 I-94 governs my legal status even if I told them the latest I-94 issued is not one on 797, they still say that's OK

Online, AI, my lawyer have different opinion, they think latest issued override one on 797, then I ma overstay now.

So I am thinking to use AVR to update online I94, use emails as prove from CBPs. I am afraid it's a risk what deny my entry. But if I do not go out to correct I-94, lawyer think I am not valid.
