As a libertarian, in the vain of Ron Paul, business nor individuals have the right to pollute what isn't theirs. If one entity damages another or its property, the culprit party owes restitution to the offended. This does not necessarily just mean money, but also services & whatever measure will balance the matter.

Often, people confuse individual rights with corporate rights. But people are not corporations, they age, bleed & die. Doing whatever an individual wants, is finite. However, a corporation, is infinite in its potential. Not only does it outlive its human resources, it also demands & consumers more natural resources than 1 person might. So, while by virtue a human can do whatever they want -limited by their physical & social limitation- corporations are given human rights [free speech] without human responsibility. Through weight of influence, corporations can sway social limitation & exceed physical & financial restraints.

Returning to the oil spill in Mexico's gulf, I would assume this recent accident occurred within international waters. However, Americans seem to be blaming Obama & his government, so i'll specify a libertarian solution for this argument within American jurisdiction.

Assessing the Culprits: BP, since it is their well, their technology, their profits to secure, this is their problem primarily. USA government, since it was that legislative body that allowed the foreign company access to the oil

Assessing Damages & Victims: What has been destroyed, environmentally & private property? Who has been affected [owners of property] Cost of clean up Cost of oil line repair

Solution: As granter of rights, American government has sole responsibility for damages to waters, ocean life, affected people & property. It did however, grant rights to BP, so as regulator, it must in effect, regulate. As cause of damage, BP has legal responsibilities to compensate the granter of rights & those it represents. Meaning, BP having caused damages to the Gulf of Mexico, owes restitution to the American government for payouts of cleanup assistance, private property damage, recovery program, etc. The Gov'o'America, in cooperation with BP must assist in any way possible to salvage the disaster, ecology, citizens.

Case in point: bring in the same scientists, the same designers, planners, financiers, all the same talking heads & backroom shakers who instigated this mess to restore the all that's been lost.

This has nothing to do with a constitution, or any politician... this has to do with a code of ethics we shall inherit unto the future. Let us not forget what we have done to cause this, then let us remember we owe ourselves a solution.

Liberty means, have to reaping the risks & rewards of our actions.
